1 Nutzungsbedingungen / Endnutzerlizenz

The English version of the Terms of Use is located further below.

1. Die Software-Lösung „CMMN Modeler for Confluence - Free“ (im folgenden „Software“) wird gemäß Einzelvertrag ausschließlich Unternehmern im Sinne von §14 des Bürgerlichen Gesetzbuches der Bundesrepublik Deutschland sowie juristischen Personen des öffentlichen Rechts oder einem öffentlich-rechtlichen Sondervermögen im Sinne des §310 des Bürgerlichen Gesetzbuches der Bundesrepublik Deutschland zur Verfügung gestellt. Informationen über die wesentlichen Funktionen und Anwendungsbereiche der Software finden sich auf unserer Internetpräsenz.

2. Der Nutzer erhält ein einfaches Nutzungsrecht an der ausgelieferten Version der Software. Der Nutzer darf die Software nicht verändern oder weiterentwickeln. Eine Dekompilierung der ausführbaren Dateien der ausgelieferten Software sowie die sonstige Rückentwicklung oder Veränderung seitens des Nutzers sind nicht zulässig.

3. Das Nutzungsrecht ist zeitlich und räumlich nicht beschränkt. Der Nutzer darf die Software nur insoweit vervielfältigen, wie dies zur vertragsgemäßen Nutzung erforderlich ist. Dies schließt das Recht ein, eine Sicherheitskopie der Software anzufertigen.

4. Die Weitergabe der Software in der überlassenen Version oder in einer geänderten / erweiterten Version an Dritte ist nicht zulässig. Dies gilt für die entgeltliche oder unentgeltliche Weitergabe auf Dauer oder auf Zeit.

5. Die Software verwendet "Open-Source-Software", für deren Nutzung die jeweiligen Open-Source-Lizenzbedingungen gelten. Die Auflistung der Open-Source-Software-Komponenten, deren Urheber sowie die geltenden Lizenzbedingungen sind dieser Nutzungsvereinbarung beigefügt.

6. Der Anbieter haftet für Mängel der Software für die Dauer von sechs Monaten ab Übergabe der Software, ansonsten im Rahmen der gesetzlichen Gewährleistung. Die Mängelbeseitigung erfolgt in der Regel durch Bereitstellung eines Updates. Die Anzeige von Mängeln durch den Nutzer erfolgt über die vom Anbieter zur Verfügung gestellten Supportwege (z.B. Ticketsystem oder Hotline). Ein Anspruch auf die Lieferung von Updates oder Upgrades außerhalb der

Gewährleistung oder sonstige Softwarewartung besteht nicht.

7. Die Haftung für leicht fahrlässige Pflichtverletzungen ist im Übrigen ausgeschlossen, soweit es sich nicht um Personenschäden handelt. Die Haftung für Schäden, die nicht Personenschäden sind oder vorsätzlich verursacht wurden, ist im Übrigen der Höhe nach begrenzt auf den typischen, vorhersehbaren Schaden. Eine Haftung für Datenverlust ist begrenzt auf den Schaden, welcher bei Verwendung einer dem Stand der Technik entsprechenden und der voraussichtlichen Schadenshöhe angemessenen regelmäßigen Datensicherung entstanden wäre. Eine etwaige Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

8. Es gilt das Recht der Bundesrepublik Deutschland. Gerichtsstand für alle Streitigkeiten aus dieser Nutzungsvereinbarung ist der Sitz des Anbieters.

2 Terms of Use / End-User License Agreement

1. The software solution “CMMN Modeler for Confluence - Free” (hereinafter referred to as “Software”)

is provided in accordance with agreements documented in an individual contract. Information

regarding the Software’s essential functions and fields of application may be found at our website.

2. User receives a simple usufructuary right to the Software’s version as delivered. User may not

modify or enhance the Software. Decompiling of executable files of the supplied Software and any

other reverse engineering or modification by user is prohibited.

3. The usufructuary right is not restricted in terms of time and place. User may reproduce the Software

solely insofar as required for use in compliance with contract. This includes the right to make a

backup copy of the Software.

4. Transfer of the Software to third parties in the surrendered version thereof or in a modified/expanded

version thereof is prohibited. This applies for permanent or temporary transfer free of charge or

against remuneration.

5. The Software utilises “open source software”; the respective open source license agreements apply

for use of open source software. A list of open source software components, their authors and of the

applicable license agreements is attached to this user agreement.

6. Use of the Software shall transpire in compliance with the following provisions and principally at

user’s own risk. The supplier shall bear liability solely for defects if he has maliciously concealed

them or if defects remained undetected to him due to gross negligence. Claims to damages due to

Software defects are solely given in the event of malicious concealment of the defect. A claim to

supply of updates or to other Software maintenance is not given.

7. Liability for minor, negligent breach of duties is excluded insofar as they do not pertain to personal

injury. Any liability pursuant to the German Product Liability Act shall remain unaffected.

8. The law of the Federal Republic of Germany applies. The venue of the supplier’s registered

corporate domicile shall apply as venue of courts for all disputes arising from this use agreement.

9. The wording of the German version of the Terms of Use shall apply in the event of dispute.
