Antike Rahmen und moderne KunstDas Zusammenspiel von antiken Rahmen und moderner Kunst ist kein Gegensatz, sondern sorgt für ein besonderes Spannungsverhältnis.

Nicht erst seit Picasso, der erwiesenermaßen ein Faible für antike Rahmen hatte, ist bekannt, dass es durchaus kein Stilbruch ist, moderne Kunst mit antiken Rahmen zu kombinieren. Vielfach treten Stilelemente in der Kunstgeschichte sowohl in Rahmen als auch in Kunstwerken immer wieder auf, so dass durch das „cross-over“ interessante Kombinationen zusammengestellt werden können.

Die Fotografien zeigen antike Rahmen, in denen verschiedene Kunstwerke der Galerie Beck & Eggeling - International Fine Art gerahmt wurden, denen wir herzlich für die Zusammen-arbeit danken. Im Einzelnen werden folgende Arbeiten gezeigt:

Antique frames and modern artworkThe interplay of antique frames and modern artwork is no contradiction; rather it creates a truly unique visual tension.

Picasso, who seemingly had a penchant for antique frames, was not the first to realise that it is not a style faux pas to combine modern artwork with antique frames. Often, style elements re-emerge time and time again throughout art history, both in frames and artwork. When combined together, these can result in fascinating style crossovers.

The photographs show antique frames, used to display various works of art from the Beck & Eggeling International Fine Art Gallery. We would like to thank the gallery for its cooperation. The following works of art are shown in detail:

Bilderrahmen und BilderleistenCONZEN fertigt zeitgenössische Rahmen und Replikas nach individuellen Vorgaben.

Die in unserer Manufaktur hergestellten Modellrahmen sind Meisterwerke der Vergolderkunst. Sie zeichnen sich durch die typische „Übereck“-Verarbeitung aus. Unsere hauseigenen Profile sowie über 2.000 Vorlagen und Varianten für Verzierungen bieten vielfältige Kombinations-möglichkeiten für eine fast unbegrenzte gestalterische Auswahl.

Abgestimmt auf den Stil des jeweiligen Bildes wird die passende Art der Rahmung und die optimale Oberflächengestaltung konzipiert. Vorbilder für die individuellen Anfertigungen sind eigene Muster und Entwürfe. Dabei können wir auch auf die Originale in unserem Museum für historische Bilderrahmen zurückgreifen.

Klassische Leistenrahmen bieten wir in vielfältigen Ausführungen an. Vom minimalistischen Naturholzprofil bis zur verzierten Echtgoldleiste lässt die umfangreiche Kollektion keine Wünsche offen. CONZEN frames are masterpieces of craftsmanship designed in typical closed-corner style. The possible combinations of our many profiles with more than 2,000 models and ornaments offer almost inexhaustible scope for design.

Each frame is matched to the style of the picture and crafted with focus on optimum surface design. Custom-built frames are modeled on our own designs and prototypes, inspired where necessary by the antique frames in our corporate frame museum.

Classic moldings are available in a variety of styles. Our extensive collection ranging from minimalist wood profiles through to ornate real gold moldings leaves nothing to be desired. All CONZEN moldings are of the highest quality, our frames having a distinctive touch due to their hand-crafted production.

Konservatorische EinrahmungCONZEN sichert den Werterhalt von Kunstwerken durch museumsgerechte Materialien und Verarbeitung.

Unsere Rahmungen erfolgen ausschließlich konservatorisch, um jedes Kunstwerk weitestge-hend vor Umwelteinflüssen zu schützen. Sämtliche Passepartouts, Auflagen, Rückwände und Pappen, die wir verwenden, sind säurefrei und alterungsbeständig. Und wir setzen nur Klebe-materialien ein, die atmungsaktiv, jederzeit wieder lösbar und ebenfalls frei von Säuren sind.

Schutz vor schädlichen Lichtstrahlen bieten UV-absorbierende Spezialgläser. Wir statten unsere Rahmen überwiegend mit Qualitätsware der Marke Schott aus, deren Produkte Mirogard Plus und Mirogard Protect einen 84%igen beziehungsweise 99%igen UV-Schutz bieten.

In der Rahmenmanufaktur CONZEN arbeiten erfahrene Spezialisten, die für den fachgerechten Umgang mit Papierarbeiten, Ölbildern und Kunstwerken aller Art besonders qualifiziert sind und eine sorgfältige Behandlung im gesamten konservatorischen Procedere sicherstellen.

Archival FramingCONZEN maintains the value of artwork with museum-style materials and methods.

Our framings are built strictly for conservational purposes to ensure that each work of art is protected to the greatest possible extent against environmental factors. We only ever use acid-free and non-aging mat boards, backings and cardboard. All our adhesives are breathable, 100% reversible and also acid-free.

The special glass we use protects against damaging UV light. We largely employ quality products made by Schott for our frames, with Mirogard Plus and Mirogard Protect offering 84% and 99% UV protection respectively.

The specialists working at our CONZEN frame factory are highly qualified with years of experience and are experts in handling works on paper, oil paintings and any type of artwork, thus ensuring proper treatment throughout the whole conservation process.

Konservierung und RestaurierungCONZEN bietet eine originalgetreue Erhaltung und Substanzsicherung von Kunstwerken.

Neben unseren überwiegend selbst ausgebildeten Fachkräften beschäftigen wir wissenschaft-liche Experten für Konservierung und Restaurierung. Im eingespielten Verbund mit externen Diplom-Restauratoren und anerkannten Fachkräften aus den Bereichen Gemälde, Papier und Fotokunst können wir daher entsprechende wert- und substanzsichernde Maßnahmen – auch über die Rahmung eines Bildes hinaus – anbieten.

So sind wir bestens vorbereitet, schädliche Veränderungen an den uns anvertrauten Kunstwer-ken zu verhindern oder zu verlangsamen. Sollten konservatorische Maßnahmen nicht mehr ausreichen, führen wir auf Wunsch auch restauratorische Eingriffe durch. Um eine systemati-sche und standardisierte visuelle Erfassung von Schäden und restauratorischen Maßnahmen vorzunehmen sowie Veränderungen des Zustands eines Kunstwerks zu dokumentieren, nutzen unsere Diplom-Restauratoren das DiVisuAL® Mapping System.

Dabei wird so wenig wie möglich am Original verändert. Außerdem achten wir von Hause aus penibel darauf, dass all unsere Eingriffe reversibel sind, um durch verbesserte Restaurierungs-techniken in Zukunft eventuell korrigiert werden zu können.

Conservation and RestorationCONZEN faithfully conserves and preserves the original material of artwork.

Alongside largely in-house trained specialists we also use science experts for conservation and restoration. Working as a team with qualified external conservators and recognized specialists in paintings, paper and photographic art, we are able to offer relevant restorative services – in addition to framing – to preserve the value and material of the original.

Using a network of specialists, we are therefore optimally prepared to prevent, or at least decelerate, the damaging effects on artwork entrusted to us. Where conservational measures are not sufficiently effective, we can also on request carry out restorative work with as little changes to the original as possible. In order to conduct a systematic and standardized visual survey of damages and restoration measures, as to document the changes in the condition of an artwork, our graduate conservators use the DiVisuAL® Mapping System.

We are equally meticulous in ensuring that all our work is reversible for potential refinement using restoration techniques developed in the future.

Maßgefertigte AusstellungsdisplaysCONZEN stellt Sockel und Glashauben zur Präsentation von Skulpturen und Plastiken her.

Neben Zeichnungen, Grafiken, Gemälden und Fotografien gehören Skulpturen und Plastiken zu den traditionellen und zeitgenössischen Kunstgegenständen, die in Galerien und Museen wie in privaten Sammlungen verbreitet sind. Auch diese sind wirkungsvoll und wertsichernd zu präsentieren.

Um dreidimensionale Objekte optimal aufzustellen und gegen Umwelteinflüsse sowie sonstige äußere Einwirkungen und Diebstahl zu schützen, fertigen wir passende Sockel, Vitrinen oder andere individuelle Ausstellungsdisplays auf Maß an.

Bei schützenden Hauben kann zwischen Plexiglas, Normalglas und Weißglas sowie Gläsern mit UV-Schutz gewählt werden. Generell sind wir, wie bei der Rahmung, aber auch hier auf jeden besonderen Kundenwunsch vorbereitet.

Customized DisplaysCONZEN crafts displays and glass hoods for sculptures.

Next to drawings, prints, pictures and photographs, sculptures are traditional and contempo-rary artwork commonly found in galleries and museums as well as in private collections. These, too, should be presented effectively and in a manner that preserves their value.

We provide customized bases, cabinets and other displays for appropriate presentation of three-dimensional objects and for protection against environmental influences, other external factors and theft.

Protective hoods can be made of acrylic glass, regular glass or white glass, and glass with UV protection. As with framing, however, we are also able to meet any other customer request

Wir bieten einen effizienten Inventarisierungsservice für öffentliche, firmeneigene und private Kunstsammlungen. Diese Dienstleistung ermöglicht die nötige Übersicht und eine verlässliche Aufstellung, die zum Beispiel zur Vorlage bei Versicherungen oder als Auflistung bei Testamen-ten, Nachlässen und Stiftungen herangezogen werden kann.

Zur grundsätzlichen Bestandsaufnahme gehören viele unterschiedliche Dienste. So fertigen wir Fotos und Beschreibungen von jedem einzelnen Kunstwerk an, begutachten den Zustand, machen Vorschläge zur Konservierung und liefern eine wertmäßige Einschätzung. In unserem Hause sind dafür langjährig erfahrene Kunsthistoriker und Restauratoren verantwortlich, die über die notwendige fachliche Kompetenz verfügen und höchste Diskretion garantieren.

Unsere Inventarisierungsoftware Art Ministration ist die digitale Basis für eine flexible und zeitsparende Verwaltung auf dem neuesten Stand der Informationstechnologie. Collection Documentation and Management CONZEN offers professional art services from documentation to digital management.

We offer an efficient documentation service for public, corporate and private collections. Documentation ensures a full overview of existing art inventories and helps to collate reliable lists for insurance and other purposes or itemized records for wills, bequests, and donations.

Basic documentation includes a variety of different services. We produce photos and detailed descriptions of each artwork, assess its current condition, make recommendations on conser-vation, and provide valuations. Our services are delivered by art historians and conservators with years of experience and the necessary expertise to guarantee utmost discretion.

Our collection documentation software Art Ministration forms the digital basis for flexible and time-saving management based on cutting-edge information technology. It facilitates the documentation of information such as artist, technique, genre, year of origin, size, signature, and condition of the artwork, which can then be provided in the required form..

Handling und Logistik CONZEN kümmert sich um Abholung, Lagerung, Verpackung, Transport und Montage.

Selbstverständlich sorgen wir für den Transport der uns anvertrauten Kunstwerke – von der Abholung bis zur Auslieferung und Aufhängung. Neben eigenen Lieferwagen setzen wir dabei auch das logistische Netz und knowhow unseres Kooperationspartners Hasenkamp ein.

Da wir mit den Gewerken vom Rahmenbau vertraut sind, bieten wir Verpackungen für Kunst-objekte aller Art an. Zusammen mit spezialisierten Logistikunternehmen fertigen wir Transpor-trahmen, Transportkoffer sowie individuell gestaltete Boxen und Kisten, die wir bei Bedarf auch mit der nötigen Klimatisierung, Schwingungsdämpfung oder anderen Spezialeinrichtun-gen ausstatten.

Zur Dienstleistungskette gehört bei CONZEN auch die fachgerechte und sichere Lagerung sowie eine professionelle Hängung inklusive der Montage ganzer Systeme. Wir installieren für Galerien komplette Präsentationen auf Kunstmessen. Und selbstverständlich bringen wir Bilder, Skulpturen oder Plastiken auch im privaten Bereich bestens zur Geltung.

Handling and Logistics CONZEN takes care of collection, storage, packaging, transportation and installation.

Obviously, we also handle the transportation of artwork entrusted to us – from collection through to delivery and installation. In addition to our own vans, we use the logistics network and know-how of our cooperation partner, Hasenkamp.

Experienced in all aspects of framing, we provide appropriate packaging for all types of artwork. In cooperation with specialist logistics service partners, we produce transportation frames and cases as well as customized boxes and crates. On request, we can also add air-conditioning, cushioning and other special equipment.

Our service range further includes professional and secure storage along with expert hanging including whole system installation. CONZEN also assists galleries with the installation of presentations at art shows. And of course we can make a feature of pictures, sculptures and other objects for private clients.

Die Werkladen Conzen Kunst Service GmbH hat langjährige Erfahrung auf dem Gebiet des Foto- und Fineartdrucks. Wir drucken auch Ihre eigenen Dateien, Scans, Fotos oder Repros auf hochwertiges Fineartpapier von Canson Infinity mit Epson Großformatdruckern bis zu einer Rollenbreite von 150 cm. Die eingesetzte HDR-Pigmenttinte garantiert herausragende Qualität und mit langer Haltbarkeit. Farbmanagement und elektronische Bildbearbeitung sind für uns selbstverständlich, um die besten denkbaren Drucke für Sie zu produzieren.

Werkladen Conzen Kunst Service GmbH has years of experience in the field of photography and fine art prints. We can also print your own files, scans, photos or repros on high-quality fine art paper from Canson Infinity using Epson large-format printers up to a roll width of 150 cm. The HDR pigment inks used during printing guarantee outstanding quality and a long-lasting finish. Colour management and electronic image processing are all part of the service to ensure that we produce the best possible prints for you.

As a master distributor of photographic paper from global market leader Canson Infinity, we are experts in handling a wide variety of paper grades in our day-to-day business. We can advise you on the most suitable medium for your picture, and can also manufacture it quickly, simply and economically.

If you would like a reproduction of your picture or photo, we can provide the entire service under one roof. We also perform high-quality scans and reproductions with cameras, as well as any necessary post-editing and digital retouching. At our factory in Fichtenstraße, our gilding and framing experts can also be watched going about their business. They are ready to explain the individual production steps involved, provide details of materials used, and highlight aspects that require particular attention in making a hand-crafted frame. Founded in 1854 in close vicinity, our company keeps a unique collection of antique picture frames in the „Altes Haus“ on Bilker Straße. It includes some very rare pieces covering the last six centuries and provides an almost complete overview of all stylistic eras – from Gothic to Renaissance, Mannerism, Baroque, Rococo, Empire, Biedermeier, and Historism through to Art Nouveau.

Versteigerungsbedingung

Mit der persönlichen oder schriftlichen Teilnahme an der Auktion oder Teilnahme via Telekommunikation wer-den die nachstehenden Bedingungen anerkannt, die sinngemäß auch für den freihändigen Nachverkauf gelten.

1. Auktionator Dr. Achim Stanneck versteigert im Namen der Werkladen Conzen Kunst Service GmbH (WCKS) für Rechnung der WCKS sowie deren Auftraggeber, die unbenannt bleiben.

2. Der Versteigerer behält sich das Recht vor, Nummern des Kataloges zu vereinen, zu trennen und wenn ein besonderer Grund vorliegt, außerhalb der Reihenfolge auszubieten oder zurückzuziehen.

3. Sämtliche zur Versteigerung gelangenden Gegenstände können vor der Versteigerung besichtigt und geprüft werden. Die Sachen sind gebraucht. Die nach bestem Wissen und Gewissen vorgenommenen Katalogbeschreibungen sind keine zugesi-cherten Eigenschaften gemäß §§ 459 ff. BGB. Die WCKS übernimmt keine Haftung für Mängel. Sie verpflichtet sich jedoch, wegen rechtzeitig vorgetragener, begründeter Mängelrügen innerhalb der Verjährungsfrist von sechs Monaten seine Gewähr-leistungsansprüche gegenüber dem Einlieferer geltend zu machen. Im Falle erfolgreicher Inanspruchnahme des Einlieferers erstattet die WCKS dem Erwerber nur den gesamten gezahlten Kaufpreis. Darüber hinaus verpflichtet sich die WCKS für die Dauer von drei Jahren seit dem Versteigerungstermin bei erwiesener Unechtheit zur Rückzahlung seiner Kommission.

4. Der Zuschlag wird erteilt, wenn nach dreimaligem Aufruf eines Gebotes kein Übergebot abgegeben wird. Der Versteigerer kann sich den Zuschlag vorbehalten oder verweigern, wenn ein besonderer Grund vorliegt. Wenn mehrere Personen zu-gleich dasselbe Gebot abgeben und nach dreimaligem Aufruf kein höheres Gebot erfolgt, entscheidet das Los. Der Verstei-gerer kann den erteilten Zuschlag zurücknehmen und die Sache erneut ausbieten, wenn irrtümlich ein rechtzeitig abgege-benes höheres Gebot übersehen und dies vom Bieter sofort beanstandet worden ist oder sonst Zweifel über den Zuschlag bestehen (§§ 2 Ziffer 4 VerstV0). Wenn trotz abgegebenen Gebots kein Zuschlag erteilt worden ist, haftet die WCKS dem Bieter nur bei Vorsatz oder grober Fahrlässigkeit. Um die Ausführung schriftlicher und telefonischer Gebote sicherzustellen, müssen diese beim Versteigerer mindestens 24h vor Auktionsbeginn eingehen. Zur wirksamen Abgabe eines schriftlichen oder telefonischen Gebotes ist die genaue Angabe der Person oder Firma des Bieters sowie der Los-Nummer erforderlich. Bei telefonischen Geboten kann nicht dafür eingestanden werden, dass eine Verbindung zustande kommt.

5. Der Zuschlag verpflichtet zur Abnahme. Mit der Erteilung des Zuschlages gehen Besitz und Gefahr an der versteigerten Sache unmittelbar auf den Ersteher über, das Eigentum erst bei vollständigem Zahlungseingang.

6. Auf den Zuschlagspreis wird ein Aufgeld von 23,5 % erhoben, in dem die Umsatzsteuer enthalten ist (Differenzbesteuerung). Für Unternehmer, die zum Vorsteuerabzug berechtigt sind, kann die Rechnung auf Wunsch (nach vorheriger Mitteilung bei Entgegennahme der Bieternummer) nach der Regelbesteuerung ausgestellt werden. Das heißt auf den Nettorechnungspreis (Zuschlagpreis + Aufgeld) wird die gesetzliche Umsatzsteuer von 19 % hinzugerechnet (Regelbesteuerung).

7. Von der Mehrwertsteuer befreit sind Ausfuhrlieferungen in Drittländer (d.h. außerhalb der EG) und – bei Angabe der USt.-Identifikations-Nr. – auch an Unternehmen in anderen EG-Mitgliedstaaten. Nehmen Auktionsteilnehmer ersteigerte Gegen-stände selber in Drittländer mit, wird ihnen die USt. erstattet, sobald der WCKS der Ausfuhr- und Abnehmernachweis vorlie-gen. Während oder unmittelbar nach der Kunstauktion ausgestellte Rechnungen bedürfen der Nachprüfung; Irrtum vorbehalten.

8. Persönlich an der Kunstversteigerung teilnehmende Ersteigerer haben den Endpreis (Zuschlagpreis zuzüglich Aufgeld und Mehrwertsteuer) sofort nach erfolgtem Zuschlag an die WCKS bar in Euro zu zahlen; eine spätere oder unbare Zahlung ist nur im zuvor getroffenen Einvernehmen mit der WCKS zulässig. Die Zahlung auswärtiger Ersteher, die schriftlich geboten haben oder durch Beauftragte vertreten gewesen sind, gilt unbeschadet sofortiger Fälligkeit bei Eingang binnen 10 Tagen nach Rechnungsdatum noch nicht als verspätet.

9. Bei Zahlungsverzug werden Zinsen in Höhe von 1% je angebrochenem Monat berechnet. Bei Zahlung in ausländischer Währung gehen ein etwaiger Kursverlust und Einlösungsspesen zu Lasten des Ersteigerers. Entsprechendes gilt für Schecks, die erst nach vorbehaltsloser Bankgutschrift als Erfüllung anerkannt werden können. Die WCKS kann bei Zahlungsverzug wahlweise Erfüllung des Kaufvertrags oder nach Fristsetzung Schadensersatz wegen Nichterfüllung verlangen. Der Schadens-ersatz kann in diesem Falle auch so berechnet werden, daß die Sache nochmals versteigert wird und der säumige Käufer für einen Mindererlös gegenüber der vorangegangenen Versteigerung und für die Kosten der wiederholten Versteigerung ein-schließlich des Aufgeldes einzustehen hat.

10. Die Ersteher sind verpflichtet, ihre Erwerbung sofort nach der Auktion in Empfang zu nehmen. Die WCKSlehnt jegliche Haftung für verkaufte Gegenstände ab. Ersteigerte Sachen werden jedoch erst nach vollständigem Zahlungseingang ausgelie-fert, bei Zahlung durch Scheck erst nach vorbehaltloser Bankgutschrift. Eine Versendung erfolgt ausnahmslos auf Kosten und Gefahr des Ersteigerers.

11. Erfüllungsort und Gerichtsstand, auch für das Mahnverfahren, ist Düsseldorf. Es gilt deutsches Recht; die Vorschriften des einheitlichen (internationalen) Kaufrechts finden keine Anwendung. Sollte eine der Bestimmungen ganz oder teilweise unwirksam sein, so bleibt die Gültigkeit der übrigen davon unberührt.

Conditions of sale(The German version of these Conditions is legally binding)

With a personal or written participation in an auction or telecommunication participation, the following Con-ditions are hereby recognized and apply analogously for subsequent private sale.

1. Auctioneer Dr. Achim Stanneck sells by auction on behalf of Werkladen Conzen Kunst Service GmbH (WCKS) and on account of WCKS and its clients, who will not be identified.

2. The auctioneer reserves the right to divide any lot, to combine any two or more lots or, if he has special reason to do so, to offer any lot for sale in an order different from that given in the catalogue or to withdraw any lot from the sale.

3. All lots put up for sale may be viewed and inspected prior to the auction. All items are used goods. The descriptions in the catalogue, which are given to the best of the auctioneer’s knowledge and belief, do not constitute trade descriptions within the meaning of §§ 459 ff. of the German Civil Code. The auctioneer does not assume any liability for faults or defects, but is prepared to forward justified complaints made by the buyer within the statutory warranty of six months to the seller who entered the item or items. Should the demands be successful WCKS will reimburse the buyer. Furthermore, WCKS agrees to reimburse its commission within a given period of three years after the date of sale if the object in question proves not to be authentic.

4. A lot will be knocked down when no overbid has been made after three calls. The auctioneer may accept bids subject to reservation or refuse any bids if he has good reason to do so. If two or more persons bid the same amount simultaneously and no overbid has been made after three calls, lots shall be drawn. The auctioneer may rescind a decision and put the lot up for sale again if a higher bid made in time has been inadvertently overlooked and the auctioneer’s attention is drawn to it by the bidder immediately or if the decision is open to other doubt (§ 2 (4) of the Auctioneers’ Regulations). If a bid has been over-looked, the bidder may only hold WCKS liable in cases of wilfulness or gross negligence. In order to ensure the execution of written or telephonic bids, the aforesaid deposit or confirmation has to be received by the auctioneer at least 24 hours before the auction. Exact details of the person or the name of the bidder and the lot number are required for a valid submission of a written bid. In telephone bidding we assume no responsibility with regard to successful telephone connections.

5. Once a lot has been knocked down, the successful bidder shall be obliged to buy it. From the fall of the hammer, every lot shall pass into the possession of, and be at the sole risk of the buyer, while ownership shall not pass to the buyer until full payment has been received.

6. The buyer shall pay a premium of 23,5 percent which includes VAT (margin scheme). For buyers who are entitled to a Pre-Tax Deduction for art and decorative art for all lots invoices can be issued according to the hitherto existing »Regelbes-teuerung« (normal regime).The buyer shall pay a premium of 15 percent on the hammer price; onto this (hammer price and premium) the statutory VAT of 19 percent added. These buyers must identify themselves when receiving their bidding paddle. Exports to third (i.e. non-EC) countries will be exempt from VAT, and so will be exports made by companies from other EC member states if they state their VAT identification number. Persons who have bought an item at an auction and export it as personal baggage to any third country will be refunded the VAT as soon as the form certifying the exportation and the export-er’s identity has been returned to WCKS. Invoices made out during an auction or immediately thereafter will be ‘‘errors ex-cepted’’ and are subject to rechecking.

7. Successful bidders attending the auction in person shall forthwith upon the purchase pay to WCKS the final price (hammer price plus premium and VAT) in cash and in Euro. Payment at a later date or otherwise than in cash will be subject to prior agreement with WCKS. Payments by foreign buyers who have bid in writing or by proxy shall also be due forthwith upon the purchase, but will not be deemed to have been delayed if received within ten days of the invoice date.

8. In default of payment, WCKS will charge interest on the outstanding amount at a rate of 1 percent per month for every month or part thereof. If payment is made in a foreign currency, any exchange rate losses and bank charges shall be borne by the buyer. The same shall apply to cheques, which will not be recognized as payment until FWCKS has received an uncondi-tional credit note from its bank. If the buyer defaults in payment, WCKS may, at its discretion, insist on performance of the contract or, if the buyer still has not paid by the date set by WCKS, claim damages for nonperformance. In the latter case, WCKS may determine the amount of the damages by putting the lot or lots up for sale again and charging the defaulting buyer the difference between the price bid by him and the price realized on the resale if this is lower, plus the cost of the resale includ-ing charges payable by WCKS.

9. Buyers shall take charge of their purchases immediately after the auction. Once a lot has been sold, the auctioneer declines all liability for it. Lots will, however, not be handed over to buyers unless full payment has been received by WCKS, in case of payment by cheque, the total amount has to be unconditionally credited to WCKS’s bank account. Shipment will be effected at the sole expense and risk of the buyer.

10. Place of performance and place of jurisdiction for any legal proceedings including default proceedings shall be Düsseldorf. Legal relations between the auctioneer anda the bidder/purchaser shall be governed by the law of the Federal Republic of Germany; provisions of the Uniform Law on the Formation of Contracts for the International Sale of Goods (ULCIS) and the Uniform Law on International Sales (UCIS) are not applicable. Should any provision hereof become wholly or in part ineffective, the validity of the remaining provisions shall not be affected thereby. The contract shall be governed by German law. In case of dispute, the German version of these Conditions of Sale shall prevail.
