Gebietsfremde Arten = Arten die aus ihrem ursprünglichen Verbreitungsgebiet heraus

mit Hilfe der Menschen in eine neue Umgebung gebracht werden (ab 1492)

Invasive gebietsfremde Arten = Arten die in ihrer neuen Umgebung Schäden

verursachen:

– Verlust der Biodiversität, Änderung der Ökosysteme, Verlust/Beeinträchtigung der

Ökosystemleistungen

– Gesundheitliche Schäden, Übertragung von Krankheiten

und Maßnahmen zu Management der Einschleppungspfade zur Verhinderung

der Einfuhr und Etablierung sind gesetzt

ZU GEBIETSFREMDEN INVASIVEN ARTEN

• Bis 2020 Identifizierung und Priorisierung invasiver gebietsfremder Arten und ihrer

Einschleppungspfade, Bekämpfung oder Tilgung prioritärer Arten und Steuerung der

Einschleppungspfade dahingehend, dass die Einführung und Etablierung neuer Arten

verhindert wird.

– Maßnahme 15: Verschärfung der Pflanzen- und Tiergesundheitsvorschriften der EU. Die

Kommission wird ihre Pflanzen- und Tiergesundheitsregelungen bis 2012 um zusätzliche

Biodiversitätsaspekte ergänzen.

– Maßnahme 16: Einführung eines speziellen Instruments für invasive gebietsfremde

Arten. Die Kommission wird bis 2012 Lücken bei der Bekämpfung von IAS mit einem

speziell entwickelten Legislativinstrument schließen.

NATIONALE BESTIMMUNGEN

Bundesluftreinhaltegesetz BGBL. 137/2002 idgF.

Ziel:

Erhaltung der natürlichen Zusammensetzung der Luft

trotz anthropogener Einflüsse

--- Veränderungen dürfen Schutzgüter nicht gefährden

--- Verpflichtung zur Luftreinhaltung - Allgemeine

Handlungs- und Unterlassungsverpflichtungen

--- Generelles Verbrennungsverbot außerhalb von Anlagen

Ausnahmen:

--- ex lege Ausnahmen vom generellen Verbrennungsverbot außerhalb von Anlagen

(z.B. Feuerwehrübungen, Lager- und Grillfeuer, Abflammen von Unkraut, punktuelle

Verbrennen von geschwendetem Material in schwer zugänglichen alpinen Lagen…)

--- Ausnahmen durch Verordnung des LH für biogene Materialien (taxativ im BGBL.

gelistete Fälle: z.B. Brauchtumsfeuer, Abbrennen von Stroh, punktuelles Abbrennen

von biogenem Material auf Weiden in schwer zugänglichen Lagen)

--- Individualausnahmen durch Bescheid der BVB (auf Antrag, sofern LH keine VO,

zB Verbrennung von Rebholz, Schädlingsbekämpfung)

Ausnahmen:

--- Sicherheitsvorkehrungen (§ 3 Abs. 6)

- Beeinträchtigungen so gering wie möglich halten!

- keine Gesundheitsgefährdung, unzumutbare Belästigung der Bevölkerung

- rechtsverbindliche Auflagen und/oder Bedingungen

Conclusio: Das Verbrennen abgeschnittener oder ausgerissener

invasiver Neophyten außerhalb von Anlagen, die dafür

geeignet sind, ist verboten!

Abfall (AWG 2002): Behandlung biogener Materialen

--- Abfallhierarchie: Verwertung ist Beseitigung vorzuziehen – Beschaffung

des Materials ist ausschlaggebend (z.B. holzig oder krautig, Samenbildung)

--- Abfallverwertung:

* Aerobe biolog. Behandlung – Kompostierung; Anlage gemäß „Stand der

Technik“ der Kompostierung; Kompostverordnung ist einzuhalten

* Anaerobe biolog. Behandlung - Vergärung in Biogasanlage

* Energetische Verwertung – Biomasseheizwerk (genehmigte Anlage)
