Die Randbegrenzungen für Sand kasten aus dem stllum-Pro-gramm werden aus Gummi-granulat hergestellt und über-zeugen durch ihre weiche und angenehme Oberfläche. Sie sind dauerhaft warm und haben eine splitter freie Oberfläche. Un-ser Sandbagger „tollo“ lässt die Herzen kleiner Bau meister höher schlagen. Einbautiefe 200 mm:Generell kann die Einbautiefe der Spielplatzgeräte auf 200 mm verkürzt werden. Dies wird jedoch als Sonderan fertigung gewertet und muss bei der Bestellung gesondert angegeben werden. Hierbei ist ein Einbau von synthe-tischem Fallschutz erforderlich.

Einbautiefe 450 mm:Bei Verwendung von losem Füllmaterial, wie Sand oder Rindenmulch, da dieses Material einem “Wegspieleffekt” unterliegen kann. In unseren technischen Zeichnungen sind alle Geräte mit der jeweils größten Einbautiefe abgebildet.

Product modificationsDue to the constant further devel-opment of our products and due to possible normative changes, we must expressly reserve the right to make technical and optical modifi-cations to our products.

Installation depthIn our catalogue, next to the equip-ment descriptions, you will some-times find different installation depths. These are required so that no danger of injury arises from the foundations. The installation depths are dependent on the type of floor being used or on the construction of the equipment.

To illustrate:Installation depth »0«= play level:The foundation is covered by the equipment or due installation/ assembly on firm ground, no foun-dation is required.

Installation depth 150 mm:When using synthetic fall protection or other firm ground, as these pro-vide lasting cover for the founda-tion.

Installation depth 200 mm:The installation depth can be short-ened to 200 mm. This will be seen as a custom-made product and has to be declared separately when placing the order. Installation of synthetic impact protection is absolutely necessary.

Installation depth 450 mm:When using loose filling materials such as sand or bark mulch, as these materials can succumb to a »wear- and-tear« effect.

The warranty covers the delivery of equivalent spare parts. The warran-ty shall be valid from the date of delivery to the customer.

Precondition for the entry into force of the warranty is that the mainte-nance of our stilum products has to be executed by trained staff (according DIN EN 1176-7, 8.2.2) and also according to the guidelines of the employee. If necessary, a pro-fessional reparation using original spare-parts has to be made. The documentary of the proper mainte-nance (submission of the complete control and maintenance report shall be made according to the guidelines of DIN EN 1176, part 7 ) has to be performed by the employer and/or the operator of the playing equipment.

Da für Sie als Planer oder Betreiber von Spielplätzen Mindesträume und Anforderungen an Böden von hohem Interesse sind und die nach-folgenden Begriffe auch in unseren Datenblättern ständig verwendet werden, möchten wir Ihnen zum leichteren Verständnis einige kurze Erläuterungen geben.

1. Wichtige NormenGrundlage für die Anforderungen an Spielplatzgeräte und somit für die Sicher heit der Geräte ist die jeweils aktuelle Fassung DIN EN 1176, Teil 1-7 und darüber hinaus für barrierefreie Spielplatzgeräte die DIN 33942. Die Anforderungen an stoßdämpfende Spielplatzböden sind in der DIN EN 1177 geregelt.

Für die Planung von Spielplätzen sind die DIN 18034 „Spielplätze und Freiräume zum Spielen – Anforderungen und Hinweise für die Planung und den Betrieb” sowie die einschlägigen Normen für barrierefreies Spielen (DIN 18024 und 180309) zu beachten.

2. Wichtige Begriffe

2.1. GeräteraumDer Raum, der durch das jeweilige Spielgerät ausgefüllt wird.

Der Fallraum muss frei von Hindernissen sein und muss den Anforderungen an Stoßdämpfung gem. DIN EN 1177 genügen.

Fallräume können sich überschnei-den – bei Schaukeln und Karussells sollte dies jedoch vermieden werden.

2.4. MindestraumDie Summe aus Geräteraum, Freiraum und Fallraum (s. Skizze) – somit der Raum, der für die sichere Benutzung des Geräts benötigt wird.

2.2. FreiraumDer Raum, der von einem Benutzer bei einer durch das Spielgerät ver-ursachten Spielbewegung eingenommen wird (z. B. Rutschen, Schaukeln, Wippen).

Freiräume von Spielgeräten dürfen sich nicht überschneiden!

2.3. FallraumDer Raum, der von einem Benutzer ein genommen werden kann, wenn er von einem erhöhten Teil des Gerätes fällt.

Die für die Spielplatzplanung wich-tige Ausdehnung des Fallraumbereichs wird durch die freie Fallhöhe bestimmt. Bei einer freien Fallhöhe von 60 cm bis zu 150 cm beträgt die Fallraumbreite grundsätzlich 150 cm. Ab einer frei-en Fallhöhe von 150 cm bis zu der maximal erlaubten freien Fallhöhe von 300 cm, wird die Breite des Fallraums nach der Formel „freie Fallhöhe in cm x 2/3 + 50 cm” errechnet. 2.6. Play levelLevel of a playground from which the use of a piece of equipment begins.

SafetyTo ensure the greatest possible safety for children in the use of playground equipment, all Stilum playground equipment meets the current European safety standard for children’s play equipment DIN EN 1176, part 1-7.

The Stilum fall protection products fulfil the current European safety standard DIN EN 1177.

Because minimum spaces and requirements concerning the ground are of particular interest for you as the planner or operator of playgrounds, and the following terms are also used in our data sheets, we would like to provide you with some short explanations for ease of understanding.

1. Important standards

The basis of the requirements for playground equipment and thus for the safety of the equipment are based upon the respectively cur-rent version of DIN EN 1176, part 1-7 and also DIN 33942 for barrier-free playground equipment.

The requirements for shock-absor-bing playground floors are set out in DIN EN 1177.For the planning of playgrounds, the DIN 18034 ”Playgrounds and open spaces for playing – require-ments and instructions for planning and operation” and the relevant standards for barrier free play (DIN 18024 and 180309) are to be obser-ved.

The falling space must be free of obstacles and must fulfil the require-ments for shock-absorbance in accordance with DIN EN 1177.

Falling spaces can overlap – but this must be avoided with swings and roundabouts.

2.4. Minimum spaceThe total of equipment space, free space and falling space (see sketch) – this is the space that is required for safe use of the equip-ment.

2. Important Terms

2.1. Equipment spaceThe space that is occupied by the respective play apparatus.

2.2. Free spaceThe space that is taken up by a user in a play movement caused by the play equipment (e.g. sliding, swinging, rocking).

The free spaces of the pieces of place equipment must not overlap!

2.3. Falling spaceThe space that can be taken up by a user, if he falls from a raised part of the equipment.

The extent of the fall space area, which is important for the planning of playgrounds, is determined by the free falling height. In the case of a free falling height of 60 cm to 150 cm, the clearing width is always 150 cm. From a free falling height of 150 cm up to the maximum permit-ted free falling height of 300 cm, the width of the falling space is cal-culated in accordance with the for-mula ”free falling height in cm x 2/3 + 50 cm”. The following diagram and table is for simplification:

Um verantwortungsvoll die Sicherheit für Kinder zu gewährleisten, bedürfen im Freien aufgestellte Spielgeräte einer regelmäßigen Inspektion und Wartung. stilum Spielgeräte sind auf-grund ihrer hohen Design- und Material-Qualität auf lange Nutzungsdauer bei niedrigen Wartungsintervallen ausgelegt.

Dennoch sind die klaren Vorgaben nach DIN EN 1176 auch für stilum Spielgeräte verbindlich. Auf Wunsch über-nehmen wir auch Wartungs- und Reparaturleistungen.

Achtung:Bei stark beanspruchten oder durch Vandalismus gefähr-deten Spielplätzen, bei extremen Witterungseinflüssen oder bei einem Standort in Küstennähe sind die Inspektionsintervalle entsprechend zu verkürzen.

Um den Anforderungen an die Verkehrssicherungspflicht und den haftungsrechtlichen Erfordernissen zu entspre-chen, müssen die regelmäßigen Kontrollen, Wartungen und Instandhaltungen dokumentiert werden.

Auch die Überprüfung der Einhaltung von Wartungsintervallen sowie die Kontrolle der sach- und fachgerechten Durchführung der Arbeiten gehören zu den Pflichten des Betreibers/Trägers, dem generell die Verantwortung für Wartung und Instandhaltung der Spielgeräte obliegt.Informieren Sie sich unbedingt über die sich daraus erge-benden Erfordernisse bzw. Pflichten wie sie zumindest teil-weise in der EN 1176-Teil 7 aufgeführt sind.

In order to responsibly ensure children’s safety, play equipment that is set up outdoors requires regular inspection and maintenance. The high quality of the design and materials of stilum play equipment mean

that it has a long, useful life with short maintenance inter-vals. Nevertheless, the clear instructions of DIN EN 1176 are also binding for stilum play equipment. We also take over maintenance and repair work upon request.

Attention:In the case of playgrounds that are subjected to heavy use, at risk of vandalism, or exposed to extreme weathe-ring, or in the case of a site close to the coast, the inspec-tion intervals are to be shortened accordingly.

In order to meet the requirements regarding the legal duty to maintain safety and the law on liability, the regu-lar checks, maintenance and servicing must be docu-mented.

The duties of the operator/sponsor, upon whom general responsibility for maintenance and servicing of the play equipment is incumbent, also include checking that maintenance intervals are adhered to and checking that the work is properly and appropriately carried out. It is absolutely necessary that you find out about the require-ments and/or duties arising from this, as at least partially listed EN 1176, part 7.

11. Geltungsbereich, Ausschluss von AGB des Kunden stilum erbringt Lieferungen und Leistungen gegenüber Unternehmern, juristischen Personen des öffentlichen Rechts und öffentlich-rechtlichen Sondervermögen ausschließlich auf-grund der nachfolgenden Allgemeinen Geschäftsbedingungen. Von diesen Geschäftsbedingungen abweichende oder entge-genstehende Bedingungen des Kunden erkennt stilum nicht an, es sei denn stilum bestätigt deren Geltung ausdrücklich in Textform. Die Geschäftsbedingungen von stilum und die Ablehnung abweichender oder entgegenstehender Bedingungen des Kunden gelten auch dann, wenn stilum in Kenntnis abweichender oder entgegenstehender Bedingungen des Kunden Lieferungen oder Leistungen an diesen vorbehaltlos ausführt.

12. Vertragsschluss Angebote von stilum sind freibleibend und unverbindlich, sofern im Angebot nicht ausdrücklich etwas anderes bestimmt ist. stilum ist berechtigt, Angebote des Kunden binnen einer Frist von vier Wochen nach deren Abgabe anzunehmen. Annahmeerklärungen sowie Auftragsbestätigung en bedürfen der Textform. Als Annahmeerklärung bzw. Auftragsbestätigung gelten bei Auftragsausführung innerhalb der Annahmefrist auch der Lieferschein bzw. die Warenrechnung.

13. Preise, Zahlungsbedingungen, Zahlungsverzug Lieferungen und Leistungen, für die nicht ausdrücklich feste Preise vereinbart sind, werden zu den am Tag des Vertrags-schlusses gültigen Listenpreisen berechnet. In Katalogen, Preislisten u. ä. von stilum angegebene Preise enthalten nicht die gesetzliche Mehrwertsteuer. Diese wird in der gesetzlichen Höhe am Tag der Rechnungsstellung in der Rechnung gesondert ausgewiesen. Tritt eine wesentliche Änderung der für die Preiskalkulation maß-geblichen Preisfaktoren (z. B. Erhöhung oder Senkung von Materialpreisen, Lohnkosten, Fracht -und Zollsätzen) ein, so kann jeder Vertragspartner die Neufestsetzung des Preises im Verhandlungswege verlangen. Kaufpreiszahlungen sind sofort fällig, werkvertragliche Vergütungsansprüche sind fällig bei Abnahme des Werkes. Verzug tritt bei Mahnung nach Fälligkeit ein, in jedem Fall aber 20 Tage nach Fälligkeit und Zugang einer Rechnung oder gleich-wertigen Zahlungsaufforderung. Befindet sich der Kunde in Zahlungsverzug, so ist stilum – unbeschadet weiterer Rechte - berechtigt, weitere Lieferungenan den Kunden nur gegen Vorkasse durchzuführen.

14. Aufrechnung, Zurückbehaltung Der Kunde kann mit eigenen Ansprüchen nur dann aufrechnen, wenn diese Ansprüche unbestritten oder rechtskräftig festgestellt sind. Dasselbe gilt für die Ausübung von Zurückbehaltungsrechten, es sei denn das Zurückbehal tungs-recht ist auf vorsätzliche oder grob fahrlässige Vertragsverletzung von stilum zurückzuführen. Der Kunde kann darüber hinaus ein Zurückbehaltungsrecht nur insoweit geltend machen, als seine Rechte auf dem gleichen Vertragsverhältnis beruhen wie die Ansprüche von stilum, gegenüber denen der Kunde die bezeich-neten Rechte geltend macht.

15. Leistungsort, Gefahrübergang, Lagerung Leistungsort ist der Sitz von stilum. Sofern nicht etwas anderes ver-einbart wurde, erfolgt die Lieferung "ab Werk". Die Verladung ist Sache des Kunden. Erfolgt die Abholung oder Versendung durch einen Spediteur oder Frachtführer, so erfolgt die Verladung durch diesen als Erfüllungsgehilfe des Kunden. Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung geht mit der Übergabe am Leistungsort auf den Kunden über. Ist die Ware oder Leistung abholungsbereit und verzögert sich die Abholung aus Gründen, die stilum nicht zu vertreten hat, so geht die Gefahr mit dem Zugang der Anzeige der Abholungsbereitschaft auf den Kunden über. Wird die Ware oder Leistung auf Wunsch des Kunden diesem zugeschickt, so geht mit ihrer Auslieferung auf den Spediteur oder Frachtführer, spätestens jedoch mit Verlassen des Werkes oder

des Lagers von stilum, die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung auf den Kunden über unabhän-gig davon, wer die Versendungskosten trägt. Soweit nicht anders vereinbart, trägt der Kunde sämtliche Transport-, Transportversicherungskosten sowie Zölle. Der Kunde hat dafür Sorge zu tragen, dass die Ware oder Leistung ihm unter der ange-gebenen Adresse zugesandt werden kann. Ist wegen Unwegsamkeit des Versendungsortes oder ähnlicher Hindernisse die Anlieferung nicht möglich, hat der Kunde die durch die gescheiterte Versendung entstandenen Mehraufwendungen zu tragen.

16. Lieferzeiten, Höhere Gewalt, Arbeitskampf Liefer- sowie Ausführungsfristen sind unverbindlich. Verein ba-rungen über verbindliche Liefertermine bedürfen der Textform. Die Lieferzeit ist eingehalten, wenn bis Ende der Lieferfrist die Abholungsbereitschaft der Ware oder Leistung dem Kunden gemeldet ist bzw. die Ware oder Leistung dem Spediteur oder Frachtführer zur Versendung übergeben wird. Richtige und rechtzeitige Selbstbelieferung aus kongruenten Deckungsgeschäften von stilum ist vorbehalten. stilum ist berechtigt, Teillieferungen vorzunehmen und diese sepa-rat zu berechnen. Die Einhaltung der Lieferverpflichtung durch stilum setzt die recht-zeitige und ordnungsgemäße Erfüllung der Verpflichtungendes Kunden voraus. Ein Verzug von stilum tritt aufgrund einer Mahnung nur ein, wenn diese in Textform erfolgt. Eine Frist zur Nacherfüllung muss ange-messen sein und in Textform gesetzt werden. Als angemessen gilt im Zweifel eine Frist von mindestens vier Wochen. Liefer- und Leistungsverzögerungen aufgrund höherer Gewalt und aufgrund von Ereignissen, die stilum unverschuldet die Lieferung oder Ausführung der Leistung wesentlich erschweren oder unmöglich machen – hierzu gehören auch nachträglich eingetretene Materialbeschaffungs schwierig keiten, Betriebsstörungen, Streik, Aussperrung, Personalmangel, Mangel an Transportmitteln, behördliche Anordnungen usw. – hat stilum selbst dann, wenn sie bei Vor-Lieferanten, deren Unterlieferanten oder Subunter neh mern eintreten, auch bei verbindlich vereinbar-ten Fristen und Terminen nicht zu vertreten. Sie berechtigen stilum, die Lieferung bzw. Leistung um die Dauer der Behinder ung zuzüg-lich einer angemessenen Anlaufzeit hinaus zu schieben oder wegen des noch nicht erfüllten Teils ganz oder teilweise vom Vertrag zurückzutreten. stilum muss dem Kunden solche Hindernisse unverzüglich mittei-len. Dauert die Behinderung länger als drei Monate, ist der Kunde nach angemessener Nachfristsetzung in Textform unter Ausschluss aller sonstigen Rechte berechtigt, hinsichtlich des noch nicht erfüllten Teils vom Vertrag zurückzutreten. Wird durch vorgenannte Umstände die Lieferung oder Leistung für stilum unmöglich, so wird sie von ihrer Liefer- bzw. Leistungsverpflichtung frei.

17. Rechte von stilum bei Pflichtverletzung des Kunden Verletzt der Kunde eine sich aus dem Vertragsverhältnis ergeben-de Pflicht, so z. B. hinsichtlich der Annahme bzw. Abholung der Ware oder Lieferung oder der werkvertraglichen Abnahme des Werkes, so kann stilum nach erfolgloser Setzung einer angemes-senen Frist vom Vertrag zurücktreten. Hat der Kunde die Pflichtverletzung zu vertreten, so hat er stilum daneben den dadurch entstandenen Schaden oder die entstandenen Mehraufwendungen (z. B. Lagerkosten) zu ersetzen, ohne dass es hierfür eine vorherige Fristsetzung erforderlich ist.

18. Eigentumsvorbehalt stilum behält sich das Eigentum an der Ware bis zur vollständigen Erfüllung des Kaufpreises sowie vollständigem Ausgleich aller Forderungen aus der Geschäftsbeziehung mit dem Kunden vor. Die Be- und Verarbeitung der Vorbehaltsware erfolgt für sti-lum, ohne sie zu verpflichten. Der Kunde ist zur Veräußerung, Verbindung oder Vermisch ung der Vorbehaltsware nur im üblichen, ordnungsgemäßen Geschäftsgang und mit der Maßgabe berechtigt und ermäch-tigt, dass die nachfolgend beschriebenen Forderungen auf stilum wirksam übergehen. Zur anderen Verfügung über die

Vorbehaltsware, insbesondere Verpfändung oder Sicherungsübereignung, ist der Kunde nicht berechtigt. Der Kunde tritt bereits jetzt sämtliche aus der Veräußerung der Vorbehaltsware bzw. der Verbindung oder Vermischung der Vorbehaltsware mit anderen Gegenständen entstehenden Forderungen (einschließlich sämtlicher Saldoforder ungen aus Kontokorrenten) in Höhe des Wertes der Vorbe halts ware mit allen Nebenrechten und im Rang vor dem Rest an stilum ab. stilum nimmt diese Abtretung an. Als Wert der Vorbehaltsware wird ver-einbart der von stilum in Rech nung gestellte Betrag zuzüglich eines Sicherungsauf schla ges von 10 %, der jedoch außer Ansatz bleibt, soweit ihm Rechte Dritter entgegenstehen. Bei Zahlungsverzug des Kunden ist stilum nach erfolgloser Setzung einer angemessener Frist für die Zahlung berechtigt, die Ware zurück zu verlangen. Nach Rücknahme der Ware ist stilum zur bestmöglichen Verwertung berechtigt. Der Verwertungserlös ist auf die Verbindlichkeit des Kunden – abzüglich angemessener Verwertungskosten – anzurechnen. Der Erfüllungsanspruch des Kunden erlischt in diesem Fall. In der Zurücknahme sowie in der Pfändung der Vorbehaltsware durch stilum liegt kein Rücktritt vom Vertrag. stilum ermächtigt den Kunden widerruflich, die an sie abgetretenen Forderungen für Rechnung von stilum in eigenem Namen einzu-ziehen, solange er seinen Verpflichtungen gegen-über stilum nachkommt, nicht in Zahlungsverzug gerät und kein Antrag auf Eröffnung eines Insolvenz- oder Vergleichsverfahrens gestellt ist. Auf sein Verlangen hin hat der Kunde stilum die Schuldner der an stilum abgetretenen Forderungen zu benen-nen, diesen die Abtretung anzuzeigen, alle zur Einziehung erfor-derlichen Angaben über die abgetretenen Forderungen zu machen sowie die zur Einziehung erforderlichen Unterlagen aus-zuhändigen. Auch stilum ist ermächtigt, den Schuldnern die Abtretung anzuzeigen. stilum ist verpflichtet, Sicherheiten freizugeben, wenn und soweit diese die zu sichernden Forderungen um mindestens 20 % über-steigen. Bei Zugriffen Dritter auf die Vorbehaltsware ist der Kunde ver-pflichtet, auf das Vorbehaltseigentum hinzuweisen und stilum über den Zugriff unverzüglich zu unterrichten.

19. Gewährleistung, Produktbeschreibung Die Gewährleistungsfrist beträgt bei dem Kauf neuer Sachen zwei Jahre ab Ablieferung, es sei denn, das Gesetz sieht gemäß §§ 438 Abs. 1 Nr. 2 BGB (Bauwerke oder Sachen für Bauwerke) oder 479 Abs. 1 bzw. Abs. 2 BGB (Rückgriffsanspruch) eine längere Frist vor. Gewährleistungsrechte bei dem Kauf gebrauchter Sachen sind ausgeschlossen. Soweit eine ordnungsgemäß erstattete Mängelanzeige begrün-det ist, ist stilum berechtigt, nach ihrer Wahl eine Ersatzlieferung vorzunehmen. Das Recht zur Nachlieferung hat stilum beim Kauf nicht, wenn und soweit der Kunde Rückgriffsansprüche gemäß den §§ 479 Abs. 1 bzw. Abs. 2 BGB geltend macht. Schlägt die Ersatzlieferung fehl, ist der Kunde nach seiner Wahl berechtigt, vom Vertrag zurück zu treten oder die Rückgängigmachung (Wandelung) des Vertrages oder die entsprechende Herab-setzung des vereinbarten Preises (Minderung) bzw., wenn die gesetzlichen Voraussetzungen hierfür erfüllt sind, Schadensersatz zu verlangen. Der Kunde darf nach Erkennen eines Mangels keine Änderungen an den gelieferten Waren vornehmen. Andernfalls ist jegliche Gewährleistung ausgeschlossen. Ist der Mangel zurückzuführen auf die Leistungsbeschrei bung, auf Anordnungen des Kunden oder auf von diesem gelieferte oder vorgeschriebene Stoffe, so ist stilum von der Gewährleistung für diese Mängel frei, außer wenn er eine ihm obliegende Mitteilung über die zu befürchtenden Mängel unterlassenhat. Zusicherungen von Eigenschaften der Ware oder Leistung bedür-fen der Textform. Angaben in Werbeschriften sind unverbindlich und begründen keine Zusicherungen. Soweit zwischen den Vertragspartnern nichts anderes vereinbart ist, ergibt sich der ver-traglich vereinbarte Gebrauch der Waren oder Leistungen von stilum aus den in den Produktbeschreibungen und Katalogen angegebenen Anwendungszwecken. Mängel, die darauf zurückzuführen sind, dass die Waren oder Leistungen entgegen den in Produktbeschreibung und Katalog angegebenen Verwendungszwecken verwendet werden oder darauf, dass der Kunde sich trotz Beratung durch stilum für ein anderes als das von stilum für den vom Kunden beabsichtigten Zweck als geeignet empfohlene Produkt oder Werk entschieden

hat, sind von der Gewährleistung ausgeschlossen. Mängel, die darauf beruhen, dass der Kunde die Ware oder Leistung nicht gemäß den Anleitungen von stilum fachgerecht eingebaut hat, sind von der Gewährleistung ausgeschlossen. Geringe Farbabweichungen der Waren untereinander sowie von Farbtafeln sind produktionsbedingt und berechtigen den Kunden nicht zur Geltendmachung von Gewährleistungsansprüchen. Hinsichtlich der Länge und Breite sind Maßtoleranzen von +/- 1 % zulässig, bei der Stärke von +/- 2mm. Geringe Farbabweichungen der Waren untereinander sowie von Farbtafeln sind produktions-bedingt und berechtigen den Kunden nicht zur Geltendmachung von Gewährleistungs-ansprüchen. Die Oberflächenbeschichtung unterliegt einer von der Art und Weise der Benutzung abhängigen Abnutzung. Diese Abnutzungserscheinungen, die zu sichtbaren Farbunterschieden führen kann, sind produktimmanent und stellen keinen Mangel dar. Starke UV-Einwirkung kann neben einer leichten Kreidung zu geringfügigen Verfärbungen der Oberfläche führen. Dies beein-trächtigt die weiteren Beständigkeitswerte nicht. Nach (HIC 1000) EN 1176/77 gemessene und zertifizierte Fallschutzwerte beschrei-ben den Zustand der Waren oder Leistungen bei Lieferung. Sie können in Abhängigkeit von der Einsatzart, der Umgebung und dem Einwirken äußerer Umstände während der Nutzung Veränderungen unterliegen. Bei Verwendung der Ware oder Lagerung in dauerhaft feuchter Umgebung sind Formveränderungen, Stockflecken, Algenbildung und ähnliche feuchtigkeitsbedingte Erscheinungen möglich. Der Kunde ist bei einer Mängelrüge, soweit ihm dies zumutbar ist, verpflichtet, den Mangel möglichst detailliert zu beschreiben. Dies umfasst insbesondere auch die Beschreibung des Untergrundes, der Art und Weise des Einbaus, der Witterungs- und sonstiger Einflüsse sowie die Übermittlung aussagekräftiger Detailfotos.

10. Haftungsbeschränkungen Für Schäden haftet stilum nur dann, wenn sie oder einer ihrer Erfüllungsgehilfen eine wesentliche Vertragspflicht (Kardinalpflicht) in einer den Vertragszweck gefährdenden Weise verletzt hat oder der Schaden auf grober Fahrlässig keit oder Vorsatz von stilum oder einer ihrer Erfüllungsgehil fen zurückzufüh-ren ist. Erfolgt die schuldhafte Verletzung einer wesentlichen Vertragspflicht (Kardinal pflicht) nicht grob fahrlässig oder vorsätz-lich, so ist die Haftung von stilum auf den Schaden beschränkt, der für sie bei Vertragsschluss vernünftigerweise voraussehbar war. Der Kunde ist verpflichtet, sich über die Eigenschaften, sachge-mäße Verwendung sowie bestehende Risiken, insbesondere betreffend eine nicht sachgemäße Verwen dung, der Produkte zu informieren und diese Informationen auch seinen Abnehmern zu übermitteln. Eine Haftung von stilum für Schäden, die durch nicht sachgemäße Verwendung der Produkte entstehen, ist ausge-schlossen. Die vorgenannten Beschränkungen der Haftung von stilum gelten für vertragliche und außervertragliche Ansprüche. Die Haftung aufgrund zwingender gesetzlicher Vorschriften, vertraglicher Vereinbarung oder Zusicherung sowie wegen Personschäden und deren Folgen bleibt unberührt.

11. Abtretungsausschluss Die Abtretung von Forderungen des Kunden, die keine Geldforderungen sind, bedarf der schriftlichen Zustimmung von stilum. stilum wird die Zustimmung nur bei Vorliegen sachlicher Gründe verweigern.

12. Erfüllungsort, Gerichtsstand, anwendbares Recht Erfüllungsort für alle Verpflichtungen aus dem Vertrags verhältnis ist der Sitz von stilum. Ausschließlicher Gerichtsstand ist, sofern nicht gesetzliche ein anderer ausschließlicher Gerichtsstand vorgeschrieben ist, der Sitz der stilum GmbH, Gewerbegebiet Larsheck, 56271 Kleinmaischeid (Deutschland). stilum ist jedoch darüber hinaus berechtigt, den Kunden an sei-nem allgemeinen Gerichtsstand zuverklagen. Für diese Geschäftsbedingungen und die gesamten Rechtsbeziehungen zwischen den Vertragspartner gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Bestimmungen zum Einheitlichen UN-Kaufrecht beweglicher Sachen (CISG).

11. Scope of application, exclusion of the customer’s general terms and conditions stilum shall perform deliveries and services towards compa-nies, legal entities under public law and special funds under public law only subject to the following General Terms and Conditions. stilum shall not accept customer’s terms and conditions differing from or conflicting with these General Terms and Conditions, unless stilum explicitly confirms their validity in writing. The Terms and Conditions of stilum and the rejection of differing or conflicting terms and conditions of the customer will also be applicable if stilum, aware of differing or conflicting terms and conditions or the customer, performs deliveries and services to this customer without reservation. In case of litigation, the German version of the General Terms and Conditions will exclusively prevail.

12. Conclusion of a contract Quotations by stilum shall be without engagement and not bin-ding, unless otherwise explicitly specified in the quotation. stilum shall be entitled to accept quotations made by the customers within a period of time of four weeks after their submittal. Declarations of acceptance as well as acknowledgements of order shall need to be in writing. In case of an execution of the order within the time limit for acceptance, the delivery note and/or the commercial invoice shall also be considered to be decla-rations of acceptance and/or akknowledgements of order.

13. Prices, terms of payment, default in payment Deliveries and services for which fixed prices are not explicitly agreed shall be charged at the list prices applicable at the day of the conclusion of the contract; prices stated in catalogues, price lists etc. of stilum do not include the statutory value-added tax. This tax shall be stated separately to the statutory amount applicable at the day of invoicing. If an essential change in the price factors decisive for price cal-culation (e. g. increase in or lowering of prices of material, labour costs, freight charges or rates of customs) occurs, either contract party will be entitled to request the revision of prices by negotiati-on. Payments of purchase prices shall become due immediately. Claims for compensation under a service contract shall become due at acceptance of the service. Default shall occur in case of a warning upon maturity, in any case, however, 20 days after maturity and receipt of an invoice or equivalent request for pay-ment. If the customer is in default of payment, stilum shall be entitled – notwithstanding further rights – to perform further deliveries to the customer only against advance payment.

14. Offsetting, retention The customer will only be allowed to offset against own claims if these claims are uncontested or have been finally determined. The same shall apply for the exercise of rights of retention unless the right of retention is due to an intentional or grossly negligent breach of contract by stilum. Besides, the customer will only be allowed to exercise a right of retention if its rights are founded on the same contractual relati-onship as the claims of stilum against which the customer asserts these rights.

15. Place of performance, passing of risks, storage Place of performance shall be the registered office of stilum. Unless otherwise agreed, the delivery shall be performed ”ex works”. The customer shall be responsible for loading. If the pick-up or shipment is accomplished by a forwarding agent or a carrier, the loading will be performed by this person as a vicarious agent of the customer. The risks of accidental loss or accidental deterioration shall pass to the customer upon handing-over at the place of performance. If the goods or the services are ready for collection and the pick-up is delayed for reasons stilum is not responsible for, risks will pass to the customer upon receipt of the notice of readiness for pick-up.

If the goods or services are sent to the customer at the customer’s request, the risks of accidental loss and of accidental deteriorati-on will pass to the customer upon their delivery to the forwarding agent or the carrier, at the latest, however, upon leaving the works or the warehouse of stilum, regardless of who will bear the forwarding expenses. Unless otherwise agreed, the customer shall bear all costs of transport, transport insurance as well as customs duties. The customer shall have to make sure that the goods or services can be sent to it at the indicated address. If the delivery is not possible for impassability of the shipping point or similar obstacles, the customer will have to bear the additional expen-diture arisen through the failed shipping.

16. Delivery times, force majeure, labour dispute Terms for delivery and execution shall not be binding. Agreements on binding delivery dates need to be in writing. The delivery time will be complied with if by the end of the delivery period the readiness of the goods or the service for pick-up has been reported to the customer or the goods or services have been handed over for dispatch to the forwarding agent or the carrier. Correct and timely self-supply out of concordant covering trans-actions of stilum shall be reserved. stilum shall be entitled to carry out partial deliveries and to invoice them separately. The compliance with the obligation of delivery by stilum shall require the timely and proper fulfilment of the obligations of the customer. A default of stilum on account of a warning will only occur if this warning is in writing. A time limit for subsequent performance must be reasonable and must be fixed in writing. In case of doubt, a time limit of at least four weeks shall be considered to be reasonable. stilum will not be responsible for delays in delivery and service due to force majeure and due to events making it more difficult or impossible for stilum to deliver or to perform the service through no fault of stilum – including but not limited to subsequently occurred difficulties in the procurement of materials, breakdowns, strike, lockout, shortage of staff, shortage of means of transport, administrative orders etc, - even if they occur with suppliers, their sub-supplier or subcontractor, even in case of definitely agreed time limits and dates. They shall entitle stilum to postpone the deli-very or the service by the term of the impediment plus a reaso-nable preparatory period or to completely or partly withdraw from the contract for the part not yet fulfilled. If the impediment persists for more than three months, the customer will be entitled to withdraw from the contract regarding to the part not yet ful-filled after fixing of a reasonable final deadline in writing. If the delivery or service becomes impossible for stilum due to the above-mentioned circumstances, it will be exempted from its obli-gation of delivery or service.

17. Rights of stilum in case of breach of obligations by the customer If the customer violates an obligation arising under the contractu-al relationship, as e. g. regarding the acceptance or pick-up of the goods or services or the acceptance of the service under the service contract, stilum will be entitled to withdraw from the con-tract after unsuccessful fixing of a reasonable time limit. If the cli-ent is responsible for the breach of duty, it will have to compensa-te stilum for the damages arisen due to that breach of duty or for the additional expenditure arisen (e. g. storage costs) in addition without a prior fixing or a time limit being necessary.

18. Reservation of title stilum shall reserve the right of property of the goods until the complete fulfilment of the purchase price as well as the comple-te settlement of all claims under the business relationship with the customer. The treatment and processing of the reserved goods shall be accomplished for stilum without obliging it. The customer shall be authorised and entitled to the sale, adjunc-tion and confusion of the reserved goods only in the usual and proper course of business provided that the claims described in the following effectively pass over to stilum. The customer shall not

be entitled to dispose otherwise of the reserved goods, in particu-lar to pledging and assignment as security. The customer shall assign to stilum already now all claims arising from the sale of the reserved goods or the adjunction or confusi-on of the reserved goods with other goods (including any balan-ce claims from current accounts) to the amount of the value of the reserved goods together with any ancillary rights and any priorities in rank in relation to any other claims. stilum shall accept this assignment. As the value of the reserved goods shall be agreed the amount invoiced by stilum plus a security of 10 % which is, however, not taken into account as far as third-party rights are conflicting with it. In case of default in payment of the customer stilum shall be entitled to demand the goods back after unsuccessful fixing of a reasonable time limit for the payment. After the taking back of the goods, stilum shall be entitled to the best possible realisation. The realisation proceeds shall be charged up against the liability of the customer – minus reasonable realisation costs. In this case, the claim to performance of the customer shall become void. The taking back as well as the seizure of the reserved goods shall not constitute a withdrawal from the contract. stilum shall confer the revocable right on the customer to collect the claims assigned to stilum for invoices of stilum on its own behalf as long as the customer fulfils its obligations towards stilum, does not make default and no application for the opening of insolvency proceedings or composition proceedings has been filed. On request, the customer shall have to communicate to sti-lum the names of the debtors of the claims assigned to stilum, to announce to assignment to them, to give all information on the claims assigned necessary for collection as well as to remit the documents required for collection. stilum shall be allowed as well to announce the assignment to the debtors. stilum will be obliged to release securities if and as far as they exceed the claims to be secured by at least 20 %. If third parties seize the goods reserved, the customer will be obliged to point to the privileged property and to inform stilum immediately on the seizure.

19. Warranty, product description The warranty period for the purchase of new goods shall be two years beginning from delivery, unless a longer period is provided by law according to §§ 438 clause 1 no. 2 BGB (German civil code) (constructions or goods for constructions) or 479 clause 1 and/or clause 2 BGB (right of recourse). Rights to warranty in case of purchase of used goods shall be excluded. If a notice of defects properly reported is justified, stilum will be entitled to proceed to a substitute delivery at its own option. stilum will not have the right of a subsequent delivery if and as far as the customer asserts claims under a right of recourse according to §§ 479 clause 1 and/or clause 2 BGB. If the substitute delivery fails, the customer will have the right at its own option to withdraw from the contract or to demand rescission of the contract (can-cellation of contract) or the corresponding reduction of the agreed price (diminution) and/or to demand compensation for damages if the legal requirements are met. After having detected a defect, the customer shall not be allo-wed to make changes to the goods delivered. Other wise, any warranty shall be excluded. If the defect has to be attributed to the specifications, to instruc-tions made by the customer or to the material delivered or speci-fied by the customer, stilum will be exempted from the warranty for these defects unless stilum failed to perform a communication incumbent on it on the defects to be expected. Warranties of qualities of the goods or service need to be in wri-ting. Information in advertising brochures shall not be binding and shall not constitute a warranty. Unless otherwise agreed by the contract parties, the contractual use of the goods or services of stilum shall ensue from the inten-ded use indicated in the product descriptions and catalogues. Defects resulting from the fact that the goods or services are used in a way not complying with the intended use indicated in the product descriptions and catalogues or that the customer chose another product or service than the product or service recom-mended by stilum for the use intended by the customer despite consultation by stilum, shall be excluded from warranty. Defects resulting from the fact that the customer did not install the

goods or services professionally according to the instructions given by stilum, shall be excluded from warranty. Slight colour deviations between the goods as well as with regard to colour charts are due to the production process and shall not entitle the customer to assert warranty claims. With respect to length and width, dimensional tolerances of +/- 1% are acceptable, with respect to thickness the tolerance is +/- 2mm. Minor deviations in the colours of the goods when comparing them to each other or to colour samples have to be attributed to the production pro-cess and do not entitle the customer to claim warranty. The sur-face cover is subject to wear depending on the sort and way of how it is used. These wear marks, which may lead to visible diffe-rences in colour, are inherent in the product and do not represent a fault. Intensive UV-light may lead to minor discolouration of the surface, apart from having a slight chalk effect, which, however, does not interfere with other factors of lasting quality. Impact pro-tection figures measured and certified according to (HIC 1000) EN 1176/77 refer to the quality of the goods or services at the time of delivery. They may be subject to changes, depending on the place of application, the environment and the influence of exter-nal factors during their useful life. Using the goods or storage them in a permanently damp environment may lead to changes in shape, mouldy spots, the development of algae or similar phe-nomena as results of dampness. They can be subject to changes depending on the type of use, the environment and the influence of external circumstances during use. In the event of a notice of defect the customer shall be obliged to a reasonable extent to describe the defect as explicitly as pos-sible. This includes in particular the description of the subsoil, the way of installation, the atmospheric influences and other influ-ences as well as the transmission of significant detailed pictures.

10. Restriction of liability stilum will only be liable for damages if it or one of its vicarious agents has breached an essential contractual obliga-tion (cardi-nal obligation) in a way endangering the purpose of the contract or if the damage is to be attributed to gross negligence or intent by stilum or one of its vicarious agents. If the culpable infringe-ment of an essential obligation (cardinal obligation) is not made grossly negligently or wilfully, the liability of stilum will be limited to the damage reasonably foreseeable for it at the conclusion of the contract. The customer shall be obliged to inform itself on the qualities, pro-per use as well as existing risks, in particular with regard to an improper use, of the products and to convey this information to its customers as well. A liability of stilum for damages arising from improper use of the products shall be excluded. The restrictions of the liability of stilum mentioned above shall apply to contractual and non-contractual claims. The liability under compulsory legal provisions, contractual agreement or warranty as well as for personal injury and its consequences shall remain unaffected.

11. Exclusion of assignment The assignment of claims of the customer that are no monetary claims shall need the written consent of stilum. stilum shall only refuse its consent in case of material reasons.

12. Place of fulfilment, place of jurisdiction, applicable law The place of fulfilment for all obligations under the contractual relationship shall be the registered office of stilum. Unless another exclusive place of jurisdiction is provided by law, the exclusive place of jurisdiction shall be the registered office of stilum GmbH, Gewerbegebiet Larsheck, 56271 Kleinmaischeid (Germany). Besides, stilum shall be entitled to sue the customer at its general place of jurisdiction. These General Terms and Conditions and the entire legal relati-ons between the contract parties shall be subject to the law of the Federal Republic of Germany, the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) being excluded.
