Following HPN Motorradtechnik terms of sale (business notes) in the German version are part of our business relationship and are accepted by placing the order.

Verkaufs-, Lieferungs- und Zahlungsbedingungen 1. Gültigkeit Mit Erscheinen dieses Kataloges verlieren alle früheren Angebote ihre Gültigkeit. Gültigkeit der Preise siehe separate Preisliste. 2. Angebote und Preise Alle unsere Angebote sind freibleibend bis zur endgültigen Bestätigung, Bestellungen werden schriftlich und telefonisch angenommen. Preiserhöhungen, die durch Zulieferer und Unterlieferanten verursacht werden, müssen wir an unsere Kunden weitergeben. Bei Preiserhöhungen über 30% kann der Kunde vom Vertrag zurücktreten. 3. Sonderbestellungen Sonderbestellungen werden nur schriftlich und gegen 50% Vorauskasse angenommen. Durch die Bestellung besteht Verpflichtung zur Abnahme der bestellten Ware oder Werkleistung. 4. Lieferung und Versand Liefertermine und -fristen, die vereinbart wurden, bedürfen der schriftlichen Bestätigung durch HPN. Beruht die Unmöglichkeit der Lieferung auf dem Unvermögen eines Zulieferers, so können beide Vertragspartner vom Vertrag zurücktreten, sofern der vereinbarte Liefertermin um 3 Monate überschritten ist. Höhere Gewalt, Streiks, unverschuldetes Unvermögen von unserer Seite oder unserer Zulieferer, sowie ungünstige Witterungsverhältnisse verlängern die Lieferfrist um die Dauer der Behinderung. Bei Sonderartikeln ist mit längeren Lieferzeiten zu rechnen. Die Lieferung erfolgt per Nachnahme bzw. Vorauskasse. Je nach Größe und Umfang der Bestellung erfolgt der Versand per Post, Bahn oder Spediteur. Eilsendung und Bahnexpress nur auf Wunsch und zu Lasten des Bestellers. Der Versand erfolgt auf Rechnung und Gefahr des Käufers. Die Gefahr geht mit der Absendung der Ware auf den Käufer über. Eine Transportversicherung wird nur auf schriftlichen Wunsch des Bestellers abgeschlossen. Sämtliche Ware verlässt unseren Betrieb kontrolliert und in technisch einwandfreiem Zustand. 5. Eigentumsvorbehalt Sämtliche gelieferte Ware bleibt bis zur vollständigen Bezahlung unser Eigentum und zwar bis zur Begleichung aller Forderungen aus der Geschäftsverbindung. Der Käufer ist nur berechtigt, die unter Eigentumsvorbehalt gelieferten Waren im regelmäßigen Geschäftsbetrieb zu veräußern. Er tritt sämtliche Forderungen aus dieser Weiterveräußerung der in unserem Eigentum stehenden Waren seinen Abnehmern gegenüber an uns ab. 6. Gewährleistungen Erhebt der Käufer Mängelrüge, so ist die Rüge, bei offen zu Tage tretenden Mängeln, nur innerhalb von 10 Werktagen zulässig; für die Fristberechnung ist der Zeitpunkt der Anlieferung und der Eingang des Rügeschreibens maßgebend. Nach Ablauf der Frist ist die Lieferung grundsätzlich anerkannt, spätere Reklamationen werden nicht berücksichtigt. Soweit Mängel anerkannt sind, wird der gelieferte Gegenstand nachgebessert oder nach unserer Wahl ersetzt. Der Käufer muss die erforderliche Zeit und Gelegenheit zur Vornahme der Nachbesserung gewähren. Fehlerhafte Ware ist kostenfrei an uns einzusenden. Weitergehende Gewährleistungs- oder Ersatzansprüche sind hiermit ausdrücklich ausgeschlossen. 7. Kennzeichnung Jede ohne unsere Zustimmung vorgenommene Veränderung der von uns gelieferten Ware ist unzulässig, sofern dadurch ein Hinweis oder Schluss auf ihre Herkunft beeinträchtigt wird. 8. Annahmeverweigerung Bei Nichtabnahme einer verbindlich bestellten Ware hat der Besteller ohne konkreten Schadensnachweis 30% des Auftragswertes für entstandene Unkosten und entgangenen Gewinn als pauschalierten Schadensersatz zu tragen. Falls der Kunde der Abnahmeverpflichtung nicht nachkommt, oder die Abnahme verweigert ist der Unternehmer berechtigt, nach einer schriftlichen Fristsetzung mit Ablehnungsandrohung, nach fruchtlosem Fristablauf vom Vertrag zurücktreten. In diesem Fall werden Schadenersatzforderungen gemäß oberem Passus wirksam. 9. Anlieferung Die Anlieferung zu bearbeitender Ware hat kostenfrei zu erfolgen. Bei unfreier Anlieferung wird die Annahme verweigert. Die Paket-zustellgebühr ist vom Besteller zu entrichten. Die angelieferten Teile müssen sauber und ölfrei, Rahmenteile sandgestrahlt sein. Maßstab hierfür ist ein, mit einem tankstellenüblichen Dampfstrahlgerät, gründlich gereinigtes Fahrzeug oder Baugruppen davon. Darüber hinaus erforderliche Reinigungs- oder Sandstrahlarbeiten werden gesondert in Rechnung gestellt. 10. Kostenvoranschläge / Instandsetzung Kostenschätzungen insbesondere mündliche sind unverbindlich. Der preis von Instandsetzungen und Reparaturen wird erst nach Fertigstellung der Arbeiten ermittelt. Schriftliche Kostenvoranschläge werden nur auf ausdrücklichen Kundenwunsch und zu lasten von ihm erstellt. Bei Überschreiten eines schriftlichen Kostenangebotes von mehr als 30% wird dem Kunden unverzüglich Mitteilung gemacht. 11. Erfüllungsort und Gerichtsstand Erfüllungsort und Gerichtsstand für beide Teile ist Seibersdorf, bzw. Eggenfelden, sofern der Kunde Kaufmann ist, oder sonst eine Vereinbarung über Erfüllungsort und Gerichtsstand rechtswirksam getroffen werden kann.

HPN Modifications of BMW GS models Here we want to give you the answers to some standard questions that come up frequently. 1. The models that can be modified in the HPN system are the following: BMW R80 G/S ’80-’87,

BMW R80ST, BMW R65GS, BMW R80GS/R100GS ’88-’95, BMW R80GS Basic.

2. Please take care that the motorcycles still fulfill your state laws after the modifications, HPN cannot be responsible for not meeting your state requirements, but we will do our best to assist you.

3. These are the possibilities to get a HPN modified bike: • Buy a brand new HPN, built to your specs. • Get your complete bike modified in our workshop. • Get your frame kit done at HPN and build up the bike yourself.

4. The HPN TÜV data sheets cover a wide variety of modifications.

8. The way to HPN:

• Coming from Munich (München): Follow Bundesautobahn A94 direction Passau for abt 110km, it changes into Bundesstrasse B12 direction Passau, leave the B12 on the B20 direction Eggenfelden/Straubing and leave the B20 after 500m direction Kirchdorf/Julbach, you reach Seibersdorf after 3km.

• Coming from Northern Germany: Follow Bundesautobahn A3 Nürnberg/Regensburg/Passau until you reach the last exit Pocking. Follow the B12 direction Munich for abt 60km, pass Simbach/Inn, leave the B12 on the B20 directon Eggenfelden/Straubing and leave the B20 after 500m direction Kirchdorf/Julbach, you reach Seibersdorf after 3km.

• Coming from the Munich Airport “Franz Josef Strauss”: Leave the airport on the secondary road direction Erding, go through Erding and go direction Dorfen, go through Dorfen on the B15. 300m after having passed Dorfen leave the B15 direction Schwindegg/Schwindkirchen, stay on this road until you reach the B12 near Heldenstein. Follow The B12 direction Mühldorf/Passau for abt 50km, leave the B12 on the B20 direction Eggenfelden/Straubing and leave the B20 after 500m direction Kirchdorf/Julbach, you reach Seibersdorf after 3km.
