Honoured judges, representatives ofthe European Patent Office, ladies andgentlemen!

Chers juges, chers membres de l'Officeeuropéen des brevets, mesdames etmessieurs,

im Namen des Präsidenten desObersten Gerichtshofs von Estlandmöchte ich alle Teilnehmer diesesSymposiums ganz herzlich begrüßen.Leider kann der Präsident aufgrundanderweitiger Verpflichtungen heute

nicht selbst anwesend sein.

Please allow me to extend the warmestwelcome from the Chief Justice of theSupreme Court of Estonia to all theparticipants of the symposium.Unfortunately, due to other workobligations, the Chief Justice was

unable to join us here today.

DasSymposium hat eine große Zahlnamhafter europäischer Patentrechts-spezialisten zusammengeführt, und ichwage zu behaupten, dass noch niezuvor so viele auf das Patentwesenspezialisierte Richter gleichzeitig hier inTallinn waren.

We are delighted that the17th European Patent Judges'Symposium is taking place in Tallinn,Estonia. The symposium has broughttogether a large number of renownedEuropean patent law specialists, and Idare say that never before have therebeen so many judges specialising inpatents at the same time here inTallinn.

C'est avec le plus grand bonheur quenous accueillons à Tallinn, en Estonie,le 17e Colloque des juges européens debrevets. Ce symposium réunit denombreux spécialistes renommés dudroit européen des brevets et je merisquerai même à dire que jamaisautant de juges spécialisés en matièrede brevets ne se sont auparavantrassemblés ici à Tallinn.

Estland ist ein kleines Land mit etwa1,3 Mio. Einwohnern. Wir besitzen kein

Gold und kein Silber, weder Öl nochGas. Auch deshalb haben wir Wissenund Weisheit stets sehr hoch geschätzt.In "Kalevipoeg" ("Kalevs Sohn"),unserem estnischen Nationalepos,findet sich folgender Leitspruch:"Großartiger als Schätze von Silber,wertvoller als Berge von Gold muss füruns die Weisheit sein".

Estonia is a small country. Ourpopulation is about 1.3 million. We have

no gold or silver, oil or gas. This is alsothe reason why we have always heldknowledge and wisdom in greatesteem. In "Kalevipoeg" ("Kalev'sSon"), the Estonian epic which hasshaped our national consciousness, thefollowing remarkable words have beennoted as a signpost: "greater thantreasures of silver, more precious thanmountains of gold, we must regardwisdom".

L'Estonie est un petit pays. Notrepopulation compte environ 1,3 million

de personnes. Nous ne disposons enoutre d'aucune ressource en or ou enargent ni d'aucune ressource pétrolièreou gazière. C'est pourquoi nous avonstoujours hautement respecté le savoiret la sagesse. Dans "Kalevipoeg" ("Filsde Kalev"), l'épopée estonienne qui afaçonné notre conscience nationale,une phrase remarquable nous aparticulièrement guidés : "Plusmagnifique que les trésors en argent etplus précieuse que les montagnes d'or,nous devons cultiver la sagesse".

Das Konzept eines auf Wissen undInnovation beruhenden Estlandstauchte bereits in der Diskussion überdas Streben nach dem sogenannten"estnischen Nokia" auf, die von LennartMeri, dem ersten Präsidenten nachEstlands wiedererlangter Unabhängig-keit, angestoßen worden war. Inzwi-schen wurde eine komplexe Innova-tionspolitik für Estland entwickelt, diesich in zahlreichen Strategiepapieren, Aktionsplänen, Programmen undProjekten niedergeschlagen hat undfester Bestandteil der Innovationspolitikder Europäischen Union ist.

The discussion initiated by LennartMeri, the first president of Estonia afterit regained its independence, onsearching for the proverbial EstonianNokia, already embodies the idea ofknowledge-based Estonia andinnovation. Today, a complexinnovation policy has been developedfor Estonia, manifested in numerousstrategy papers, action plans,programmes and projects, and it is anintegral part of the innovation policy ofthe European Union.

Les discussions sur la recherche d'un"Nokia à l'estonienne", qui ont étéinitiées par Lennart Meri, le premierprésident de l'Estonie indépendante,symbolisent déjà le concept d'uneEstonie et d'une innovation fondées surle savoir. Actuellement, une politiqued'innovation complexe est mise enplace dans notre pays et se manifestepar quantité de documents de stratégie,plans d'action, programmes et autresprojets. Ces mesures font partieintégrante de la politique d'innovationmenée par l'Union européenne.

Ich kann mit Freude berichten, dassEstland in der kurzen Zeit nach derWiedererlangung seiner Unabhängig-keit beachtliche wirtschaftliche Erfolgeerzielen konnte. Im Ranking der Inno-vationsunion für 2013 belegt Estland inSachen Innovation den 14. Rang in derEU. Was die wirtschaftlichen Auswir-kungen der Innovation angeht, stehenwir allerdings auf Rang 21. Und es be-steht kein Grund, uns damit zufriedenzu geben. Die Ergebnisse des zweitenQuartals des laufenden Finanzjahressind ebenfalls beunruhigend. DasWirtschaftswachstum ist nahezu nichtexistent - mit diesem Problem istEstland aber nicht allein. Ein geringesWirtschaftswachstum ist auch für vieleandere EU-Mitgliedstaaten und die

Europäische Union insgesamt einThema. Die Wettbewerbsfähigkeit derEuropäischen Union beginnt jedochzuhause − mit der Integration der Wirt-schaftssysteme der Mitgliedstaaten.Deshalb müssen die Kontakte zwischenden Mitgliedstaaten auf allen Ebenenund in allen Bereichen intensiviertwerden, damit die Europäische Unionvereint und auf dem Weltmarkt wettbe-werbsfähig bleibt. Es ist allgemeinbekannt, dass Innovation durchZusammenarbeit gefördert wird.

I am glad to say that in the short periodafter regaining its independenceEstonia has been able to achievesignificant economic success. Based onthe ranking compiled by the InnovationUnion for 2013, Estonia ranks 14th inthe European Union in the area ofinnovation. However, in terms of theeconomic impact of innovation, we rank21st. We have no reason to besatisfied. The results of Q2 of thecurrent financial year are alsounsettling. Economic growth is close tonon-existent. This, however, is not aproblem specific to Estonia. Pooreconomic growth is also an issue formany other European Union memberstates and the European Union as awhole. Still, the competitiveness of the

European Union starts at home – withthe integration of the economies of themember states. This is why contactsbetween the member states need to betightened in all levels and fields, toensure that the European Unionremains unified and competitive in theworld market. It is common knowledgethat cooperation facilitates innovation.

Je suis heureux de pouvoir vous direque, peu après son indépendance,l'Estonie a été capable de renouer avecun succès économique important.Selon le classement établi par l'Unionde l'innovation pour l'année 2013,l'Estonie se place au 14e rang au seinde l'Union européenne en matièred'innovation. Cependant, en termesd'impact économique de l'innovation,nous ne nous classons qu'au 21 e rang.Nous n'avons donc aucune raisond'être satisfaits. En outre, les résultatsdu 2e trimestre de l'exercice budgétaireactuel sont inquiétants. La croissanceéconomique est en effet proche dezéro. Néanmoins, cela n'est pas unproblème spécifique à l'Estonie, car lafaiblesse de la croissance économique

affecte également de nombreux autresÉtats membres de l'Union européenneainsi que l'Union européenne dans sonensemble. Il n'en demeure pas moinsque la compétitivité de cette dernières'ancre au niveau national, avecl'intégration des économies des Étatsmembres. C'est pourquoi les liens entreces États doivent être resserrés à tousles niveaux et dans tous les domaines,afin de maintenir l'unité et lacompétitivité de l'Union européenne surle marché mondial. Il est en effet denotoriété que la coopération favorisel'innovation.

Meine Damen und Herren, Ladies and gentlemen! Mesdames et Messieurs,eine Erfindung wird dann zur Inno-vation, wenn sie einen Marktwert be-kommt und wirtschaftlichen Gewinnerzeugt. Dabei geht es um eine ein-fache Frage: Wie kann aus einer Erfin-dung größerer wirtschaftlicher Nutzengezogen werden? Ebenso wichtig ist,wie gut das Rechtsschutzsystem imHinblick auf neue Erfindungen organi-siert und etabliert ist.

An invention becomes innovation whenit obtains market value and createseconomic profit. The issue is actuallyvery simple: how to gain moreeconomic benefits from the invention. Another aspect worth pointing out hereis how well the legal protection systemhas been organised and established fornew inventions.

Une invention devient une innovationlorsqu'elle acquiert une valeurmarchande et crée un profitéconomique. La question ici est en faittrès simple : comment dégager plus debénéfices économiques à partir d'uneinvention ? Un autre point méritant icid'être soulevé est l'évaluation de laqualité du système de protectionuridique par rapport aux nouvellesinventions.

Ein Instrument der Innovationspolitik istdas Rechtssystem - das alleine schafftaber noch keine Innovation. Es ist Auf-gabe des Staates, für ein rechtlichesUmfeld zu sorgen, das die Innovationunterstützt und fördert, damit Erfindun-gen auf soliden Rechtsschutz bauenkönnen, der auch für kleine und mittlereUnternehmen erschwinglich ist. Bisherwaren die Patentierungskosten einesder größten Hindernisse für die Wett-bewerbsfähigkeit von Unternehmen.

An instrument of the policy of innovationis law, but law by itself does not createinnovation. It is the state's duty tocreate a legal environment which issupportive and conducive forinnovation, so that the inventions areensured solid legal protection which isalso affordable for small and medium-sized enterprises. Until now the cost ofobtaining patents has been one of themain factors hindering thecompetitiveness of companies.

Si le droit est un instrument de lapolitique d'innovation, il ne créecependant pas lui-même l'innovation.C'est à l'État qu'il incombe d'élaborer unenvironnement juridique favorable àl'innovation, de telle sorte que lesinventions puissent bénéficier d'unesolide protection juridique dont le coûtsoit également accessible aux petites etmoyennes entreprises. Bemerkenswert ist, dass dieses Sym-posium europäischer Patentrichterzeitgleich mit der Reform des euro-päischen Patentsystems stattfindet,deren Ziel ein einheitliches europäi-sches Patent und ein EinheitlichesPatentgericht ist. Dieses vereinfachteeuropäische Patentsystem wird definitivzur Innovationsförderung beitragen undfür Unternehmen, die Patentschutzsuchen, besser zugänglich sein; gleich-zeitig wird es höhere Investitionen inForschung und Entwicklung ermög-lichen.

It is worth noting that this symposium ofEuropean patent judges is being held atthe same time as European patentsystem reform, involving the unitarypatent in the EU and the Unitary PatentCourt, is taking place. The simplifiedEuropean patent system will definitelyhelp to promote innovation and make itmore accessible for entrepreneursseeking to obtain patent protection,while also making it possible toincrease investments directed towardsresearch and development activities.

On notera que ce Colloque des jugeseuropéens de brevets intervient enmême temps que la réforme dusystème du brevet européen quiinstaure le brevet européen unitaireainsi que la Juridiction unifiée dubrevet. Le système simplifié du breveteuropéen contribuera assurément àpromouvoir l'innovation et à la rendreplus accessible aux entrepreneursrecherchant une protection par brevet.En outre, ce système permettrad'accroître les investissementsconsacrés aux activités de recherche etde développement.

Es ist großartig, dass in der Fallstudiefür das Symposium bereits das Über-einkommen über ein EinheitlichesPatentgericht angewandt wird, das vonEstland und vielen anderen Mitglied-staaten der Europäischen Union nochratifiziert werden muss. Ich möchte andieser Stelle anmerken, dass Estlandgemeinsam mit Schweden, Lettlandund Litauen von der Möglichkeit Ge-brauch gemacht hat, eine regionaleZweigstelle des Gerichts mit Hauptsitz

in Schweden einzurichten, die Streitfälleaus allen Staaten dieser Region bear-beiten kann.

It is great that the case study of thesymposium already involves theapplication of an agreement of theUnitary Patent Court, still to be ratifiedby Estonia and many other EuropeanUnion member states. I would like tonote here that, along with Sweden,Latvia and Lithuania, Estonia has usedthe option of creating a regional branchof the court, with Sweden as its mainseat, which will be able to resolvedisputes in all states of the region.

Il est heureux de constater que l'étudede cas abordée lors de ce colloquenécessite déjà l'application d'un accordrelatif à la Juridiction unifiée du brevet.Cet accord doit être encore ratifié parl'Estonie et de nombreux autres Étatsmembres de l'Union européenne. Jevoudrais souligner ici le fait quel'Estonie a choisi, avec la Suède, laLettonie et la Lituanie, de créer uneantenne régionale de la Juridictionunifiée du brevet dont le siège sera en

Suède et qui connaîtra des litigessurvenant dans tous les États de larégion concernée.

Der Schutz geistiger Eigentumsrechteist von Natur aus international. Außer-dem bedarf es bei dem Versuch, dieSchwächen des gewerblichen Rechts-schutzes zu beheben, einer internatio-nalen Lösung. Deshalb ist es von sogroßer Bedeutung, dass Patentrichteraus verschiedenen Ländern hier zu-sammenkommen können. Dies eröffnetihnen die Möglichkeit, Erfahrungen zumPatentschutz auszutauschen, die gel-tende Praxis anderer Länder kennenzu-lernen, Positionen zu unterschiedlichen Aspekten des Patentschutzes abzuglei-chen und miteinander in Einklang zubringen und sich gegenseitig zuinspirieren.

The protection of intellectual propertyrights is international in its nature. Also,the issues of overcoming theweaknesses of the legal protection ofintellectual property need to beaddressed at the international level.This is why it is very important thatpatent judges from different countriesare able to come together. It gives themthe opportunity to exchangeexperiences on patent protection, tohear about the practices in place indifferent countries, to reconcile andharmonise the opinions on differentissues of patent protection between theudges, and to serve as an inspirationfor each other.

La protection des droits de propriétéintellectuelle est, par nature,internationale. De la même façon, lesproblèmes liés aux faiblesses de laprotection juridique de la propriétéintellectuelle doivent être gérés auniveau international. C'est pourquoi ilest extrêmement important que desuges de brevets issus de différentspays puissent se réunir. Cela leurdonne en effet l'occasion d'échangerdes expériences en matière deprotection par brevet, de s'informer àpropos des pratiques en cours au seindes différents pays, de réconcilier etd'harmoniser leurs opinions respectivesau sujet de questions diverses relativesà la protection par brevet, et enfin de seservir mutuellement de sourced'inspiration.

Ein effizienter und hochwertiger Patent-schutz hängt von der Erfahrung undExpertise der Richter ab, die die Patent-streitigkeiten beilegen. So wird auchdieses einzigartige internationale Sym-posium von Patentrichtern gewiss zur

Fortbildung der Teilnehmer beitragen,ihnen Wissen vermitteln und sie so zunoch besseren Patentrichtern machen.

In the end, efficient and quality patentprotection depends on the experienceand expertise of the judges who areresolving the patent disputes. Thisunique international symposium ofpatent judges will definitely also be an

educational one, providing knowledgeto the participants and thereby makingthem better patent judges.

Au final, l'efficacité et la qualité d'uneprotection par brevet dépendent del'expérience et de l'expertise des jugesqui connaissent des litiges en matièrede brevet. Ce colloque international deuges de brevets, unique en son genre,

aura assurément aussi un caractèrepédagogique, dans la mesure où il vadistiller tout un savoir aux participantset permettre ainsi à ceux-ci de se

On display arecountless fun inventions that Lotte, aninquisitive puppy, has created together

with her companions. Such a themepark is sure to encourage the nextgeneration to think creatively, inventand become innovators of the future.However, Gadgetville is an equallyinspiring place for grown-ups too.

L'avenir de celle-ci se trouve en outreclairement illustré par le "Village deLotte baptisé Gadgetville", un parcd'attractions pour enfants qui s'estouvert cette année près de la ville dePärnu, en Estonie.
