DefinitionAllen in einer Unterkunft der Region Alpbachtal Seenland nächtigenden und lt. österreichischem Meldegesetz ord-nungsgemäß gemeldeten Gästen wird vom Alpbachtal Seenland Tourismus bzw. dem ausstellenden Vermieter für die Dauer ihres Aufenthalts die Alpbachtal Seenland Card kostenlos zur Verfügung gestellt. Die definierten Leistungen der Alpbachtal Seenland Card sind in der Card Broschüre angegeben.

Leistungsumfang/HaftungsausschlussSämtliche in der vorliegenden Broschüre angeführten Alpbachtal Seenland Card Leistungspartner haben sich verpflichtet, den Inhabern der Alpbachtal Seenland Card gemäß und unter Berücksichtigung ihrer eigenen allgemeinen Beförderungs- und Geschäftsbedingungen zeitlich und mengenmäßig ihre als Alpbachtal Seen-land Card ausgewiesenen Leistungen, zu den üblichen Geschäftszeiten, quantitativ in vollem Umfang zur Ver-fügung zu stellen. Die Inhaber der Alpbachtal Seenland Card nehmen zur Kenntnis, dass sich die Betriebszeiten einiger Partner, vor allem aus witterungs- und saisonbe-dingten Umständen, nicht mit dem gesamten Zeitraum der Card Saison decken. Bei manchen Betrieben kann es aus Kapazitätsgründen auch zu längeren Wartezeiten kommen. Die Inhaber der Alpbachtal Seenland Card erklären sich mit den angegeben Öffnungszeiten, all-fälligen Zugangsbeschränkungen und auch den Aus-lastungshinweisen der Partnerbetriebe einverstanden. Sie verzichten auf jeglichen Schadenersatz, wenn be-triebsbedingt oder ohne Verschulden der Leistungsträger die angebotenen Leistungen nicht oder nur teilweise erbracht werden. Die Leistungsträger haften zudem nur für grobe Fahrlässigkeit und Vorsatz, nicht jedoch für leichte Fahrlässigkeit. Darüber hinaus besteht kei-ne Haftung für allenfalls mitgeführte Garderobe oder sonstige mitgeführte Wertgegenstände. Die Inhaber der Alpbachtal Seenland Card nehmen des weiteren zur Kenntnis, dass der Alpbachtal Seenland Tourismus berechtigt ist, die Vereinbarung mit den einzelnen Card Leistungsträgern aus wichtigen Gründen auch während der Saison zu beenden. Es können daraus keine wie immer gearteten Ansprüche geltend gemacht werden.

AusgabevoraussetzungenDer Vermieter/Beherbergungsbetrieb ist verpflichtet, den Gast unabhängig von seiner Aufenthaltsdauer auf die Alpbachtal Seenland Card aufmerksam zu machen. Der Gast erhält von seinem Vermieter eine Alpbachtal Seenland Card für die Dauer seines Aufenthaltes aus-gehändigt. Für die Ausstellung und Verwendung der Alpbachtal Seenland gelten die nachstehenden Bedin-gungen ausdrücklich als vereinbart.

Nicht-Übertragbarkeit/VerlustDie Alpbachtal Seenland Card ist nicht übertragbar. Auf Verlangen ist ein Lichtbildausweis vorzuweisen. Die Al-pbachtal Seenland Card darf nur von jener Person benützt werden, deren Name auf der Card vermerkt bzw. ge-speichert ist. Bei Nichtinanspruchnahme der Alpbachtal Seenland Card kann kein Ersatz geleistet werden. Ein Verlust der Card ist dem Beherbergungsbetrieb unver-züglich zu melden. Nach einer Neuausstellung verliert die verlorene Card ihre Gültigkeit mit sofortiger Wirkung.

GültigkeitDie Sommer Card Saison dauert vom 1.5. – 31.10., die Winter Card Saison vom 1.11. – 30.4 jeden Jahres.Die Alpbachtal Seenland Card gilt innerhalb dieses

Zeitraumes ab dem Datum der Anreise bis inklusive zum Datum der Abreise. Auf der Card müssen Vor- und Nachname des Karteninhabers sowie die Aufenthalts-dauer gut erkennbar eingetragen sein. Nach Ablauf der angegeben Aufenthaltsdauer verliert die Alpbachtal Seenland Card automatisch ihre Gültigkeit.

VerwendungZur Erlangung der Kartenvorteile weist der Karteninhaber seine Alpbachtal Seenland Card vor. Die Card wird vom Leistungsträger durch ein Akzeptanzgerät oder durch bloße Sichtprüfung mit Notiz der Kartennummer und dem Namen des Inhabers auf ihre Gültigkeit und Iden-tität überprüft. Der Karteninhaber ist verpflichtet, auf Verlangen einen gültigen Lichtbildausweis vorzuweisen anderenfalls kann ihm die freie oder ermäßigte Leistung verweigert werden. Bei Beschädigung oder technischen Mängeln der Alpbachtal Seenland Card wird die Card vom Beherbergungsbetrieb ausgetauscht.

MissbrauchBei missbräuchlicher Verwendung oder bei Verdacht auf missbräuchliche Verwendung sind die Alpbachtal Seen-land Card Leistungspartner berechtigt und verpflichtet, die Karte ersatzlos einzubehalten. Bei Missbrauch oder begründetem Verdacht auf missbräuchliche Verwendung wird Anzeige erstattet. Der Karteninhaber haftet für missbräuchliche Verwendung der Karte durch Dritte.

Haftungsausschluss Alpbachtal Seenland Tou-rismusDie Inhaber der Alpbachtal Seenland Card nehmen zur Kenntnis, dass Alpbachtal Seenland Tourismus lediglich die Zahlungsabwicklung zwischen den Inhabern der Card und den Leistungsanbietern durchführt, ein Vertragsver-hältnis entsteht ausschließlich zwischen den Karteninha-bern und den jeweiligen Leistungsanbietern. Die Inhaber der Alpbachtal Seenland Card verzichten gegenüber dem Alpbachtal Seenland Tourismus auf jeglichen denkbaren Gewährleistungs- bzw. Schadenersatzanspruch und zwar unabhängig davon, ob nun dem Leistungsanbieter bei einem Schaden ein Verschulden anzulasten ist oder nicht. Festgehalten wird, dass – sofern es zu einem Haftungsfall kommt – Alpbachtal Seenland Tourismus nicht für einen derartigen Schadensfall haftet, zumal die Leistungsanbieter nicht Gehilfen vom Alpbachtal Seenland Tourismus sind. Ebenso steht den Inhabern der Alpbachtal Seenland Card gegenüber dem Alpbachtal Seenland Tourismus kein Schadenersatz für den Fall zu, dass allfällige in der Broschüre angeführten Leistungen von den Partnerbetrieben nicht, nicht ordnungsgemäß oder nicht vollständig erbracht werden.

GerichtsstandFür sämtliche Streitigkeiten aus der Verwendung der Alpbachtal Seenland Card bzw. allfällige Schadenersatz- oder Gewährleistungsansprüche gilt als Gerichtsstand Rattenberg. Es gilt die ausschließliche Anwendung des österreichischen Rechtes als vereinbart.

DatenschutzMit Inanspruchnahme der Alpbachtal Seenland Card stimmt der Inhaber der Card der Verwendung seiner gespeicherten Adressdaten zu Marketingzwecken durch den Alpbachtal Seenland Tourismus ausdrücklich zu, wo-bei ein Widerruf dieser Zustimmung dem Karteninhaber jederzeit möglich ist. Die Daten werden vom Alpbachtal Seenland Tourismus nicht an Dritte weitergegeben.

DefinitionAll guests spending night(s) in the Alpbachtal Seenland Region and duly registered in accordance with the Austrian registering law (österreichisches Meldegesetz) receive their Alpbachtal Seenland Card free of charge and valid for the duration of their stay, which is issued in their accommodation or by the Alpbachtal Seenland Tourismus respec-tively. The services included are defined in the Card brochure.

Specifications/exclusion of liabilityAll service partners listed in the Alpbachtal Seen-land Card brochure have committed themselves to provide Alpbachtal Seenland Card holders with the full quantitative and the period of services accounted for in this brochure taking into consi-deration their own terms of transportation and terms and conditions and in accordance with their business hours. Alpbachtal Seenland Card holders acknowledge that the operating times of some of the service partners can vary depending on weather and the season and may not cover the entire Card season. Services offered by some partners can, due to capacity limitations, entail waiting times. Alpbachtal Seenland Card holders agree to the ser-vice partners published operating times, possible admission restrictions and any references regarding capacity limits. They agree to forego any claims should the service partner through no fault of their own not or only partially deliver the stated services due to operational reasons. The service partners are only liable for acts of gross negligence or intent not however for acts of minor negligence. Furthermore no responsibility is taken for articles of clothing or items of value. Alpbachtal Seenland Card holders also take note that the Alpbachtal Seenland Tou-rismus is entitled to terminate their agreements with individual service partners during the season where deemed necessary. Consequently no claims regardless of their nature can be put forward.

Terms of issueThe accommodation provider is obliged to inform their guests - regardless of the duration of their stay - about the Alpbachtal Seenland Card. Each guest is issued a Alpbachtal Seenland Card covering the duration of their stay. The following conditions regarding in particular the issue and use of the Alpbachtal Seenland Card apply.

Non transferability/lossThe Alpbachtal Seenland Card is non transferable. On demand a valid photo ID must be presented. The Alpbachtal Seenland Card is only allowed to be used by the person whose name is printed or written on it. No refund can be awarded on non-utilisation of the Alpbachtal Seenland Card. Loss of a card is to be reported immediately to the accommodation provider. Following the issue of a new card the lost card becomes invalid with immediate effect.

ValidityThe Summer card is valid for the season 1st May to 31st October, the Winter season card is valid from 1st November to 30th April of each year. The Al-pbachtal Seenland Card is valid within these dates from the day of arrival to and including the date of departure. The holders first and surname and the duration of their stay must be clearly entered on the card. Upon expiry of the date limit the card automatically looses its validity.

Use ofSo as to benefit from the advantages offered the holder must produce his Alpbachtal Seenland Card. The card is validated by the respective service part-ner either with a card reader or by a simple visual check and noting down of the card number and card holders’ name. On demand the card holder is bound to present a valid photo ID otherwise free or reduced service can be denied. In case of damage or a technical default the accommodation provider will replace the card.

AbuseIn the event of abuse or the suspicion of abuse the service partner is entitled and obliged to withhold the card without replacement. Abuse or the rea-sonable suspicion of abuse will be reported to the police. The card holder will be held responsible for card abuse by a third party.Alpbachtal Seenland Tourismus liability exclusionAll Alpbachtal Seenland Card holders acknowledge that the Alpbachtal Seenland Tourismus is merely responsible for the handling of payments between card holders and service partners. A contract exists only between card holders and the respective ser-vice partners. All Alpbachtal Seenland Card holders refrain from any warranty or compensation claims towards the Alpbachtal Seenland Tourismus regar-dless of whether in the eventuality of damage this can be regarded as a failure on the service partners’ part. Alpbachtal Seenland Tourismus can not be held responsible or liable for any damage or claim as they are not the service partner. Equally card holders can not claim damages from the Alpbachtal Seenland Tourismus in the eventuality that services offered by service partners stated in the brochure have not been properly or entirely fulfilled.

Court of jurisdictionThe Rattenberg court of jurisdiction is responsible for any dispute settlements or respectively any warranty or compensation claims regarding the Al-pbachtal Seenland Card. The exclusive enforcement of Austrian law as stipulated is agreed.

Data protectionWith the use of the Alpbachtal Seenland Card the holder agrees to his address data being used for Alpbachtal Seenland Tourismus marketing purposes only. Revocation of this agreement is possible at any given time. The data available to the Alpbachtal Seenland Tourismus will not be passed on to any third party.

ValiditéLa carte d’été est valide pour la saison du 1er mai au 31 octobre, la carte d’hiver est valide du 1er novembre au 30 avril de chaque année. L’Alpbachtal Seenland Card est valide avec ces dates à partir du jour d’arrivée et comprend la date de départ. Le nom et surnom des titulaires ainsi que la durée de la visite doivent être lisiblement inscrit sur la carte. A l’expiration de la date limite la carte devient automatiquement non-.valide.

Son utilisationPour bénéficier des avantages qu’offre la carte aux ti-tulaires, ceux-ci doivent produire L’Alpbachtal Seenland Card. La carte est validée par le partenaire de service respectif à l’aide d’un lecteur de carte ou simplement visuellement en notant le numéro de la carte et le nom du titulaire de celle-ci. Sur demande le titulaire de la carte est obligé de produire une photo d’identité valide au risque de se voir refusé les services gratuits ou réduits.En cas de dommage ou de défaut technique le pourvo-yeur remplacera la carte.

AbusDans l’éventualité d’abus ou de suspicion d’abus le partenaire de service est autorisé et obligé de retenir la carte sans la remplacer.
