PHOTO RELEASE TO BRINKER INTERNATIONAL

Brinker International is so excited that you have agreed to participate in our promotion for our Chilis restaurants! By

submitting your photograph to Brinker, you are agreeing that we can use the photo you took and/or your name and likeness to

advertise Chilis restaurants. This may include using your photo in emails and sponsored ads, on our website and social networking

pages, or in any other way we choose anywhere in the world. You also agree that we will own the copyright in the photo and how the

photo is combined with other material to create the advertisements, but you will continue to have the right to use the photograph for

your own personal purposes (including posting it on Facebook, Twitter or other social networking sites).

1. GRANT OF RIGHTS. For valuable consideration received, I hereby grant to Brinker International, Inc. and its affiliates

(Grantee) the absolute and irrevocable right and permission, throughout the world, in respect of the photographs or video footage (the

Material) (1) that Grantee has, has taken, or has had taken of me; (2) that I have, have taken, or have had taken of me and have provided

to Grantee; or (3) in which I may be included with others and has been provided to Grantee by me or by a third party:

a. To use, re-use, publish, and re-publish, and otherwise reproduce, digitize, edit, modify, distribute, publicly

display, and publicly perform the same, in whole or in part, individually or in conjunction with other photographs or videos, and in

conjunction with any copyrighted matter, in any and all media now or hereafter known, for illustration, promotion, art, advertising

and trade, or any other purpose whatsoever; and

b. To use my name in connection with the Material if it so chooses.

2. RELEASE. I hereby release and discharge Grantee from any and all claims and demands arising out of or in connection with

the use of the photographs or footage, including without limitation any and all claims for defamation, invasion of privacy, and

misappropriation of my right of publicity.

3. COPYRIGHT IN THE MATERIAL. I acknowledge that I have waived and/or assigned to Grantee all claim to the copyrights in

the Material. Grantee has the right to copyright the Material in its own name or otherwise and to use, assign, and license the Material

throughout the world, including any rights I might have. Notwithstanding the foregoing, I understand that I will have a worldwide, perpetual,

royalty-free license to use the Material for my personal, non-commercial purposes; however, said license is limited to the Material and

does not extend to any derivative works thereof created by or for the benefit of Grantee.

4. ASSIGNMENT OF RELEASE. Grantee may sell, assign, license or otherwise transfer all rights granted to it hereunder. Thisauthorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Grantee.

5. GRANTORS REPRESENTATIONS. I am aged eighteen (18) years or older and have the right to contract in my own name.

I have read the foregoing and fully understand the contents thereof. This release shall be binding upon me and my heirs, legal represen-

tatives and assigns. I further release Grantee from any responsibility for injury incurred during the photography session.
