„Information“

• must be extensive enough and received in time in order to be able to carry out an in-depth examination of possible consequences and prepare for consultations where appropriate.

“Unterrichtung” ● muss in einer inhaltlichen Art und Weise und so rechtzeitig geschehen,

dass der EBR die möglichen Auswirkungen eingehend bewerten kann und eine eventuelle Anhörung vorbereiten kann.

“L’information” ● doit être suffisamment complète et doit être reçue à temps pour permettre

d‘examiner en détail les conséquences possibles et, au besoin, de préparer des consultations.

„Consultation “

• must take place at the appropriate managerial level, in the appropriate form, with the appropriate content and at the appropriate time so that the opinion of the EWC can be taken into account in company decision-making regarding the proposed measures.

“Anhörung” ● muss so rechtzeitig und in angemessener Weise und inhaltlichen

Ausgestaltung durch die entsprechende Führungsebene stattfinden, dass eine eventuelle Stellungnahme des EBR zu einer geplanten Maßnahme noch vom Arbeitgeber berücksichtigt werden kann.

“Consultation” ● doit avoir lieu à l‘échelon adéquat, de façon appropriée, avec le contenu

adéquat et en temps opportun, afin de permettre la considération de l‘opinion du CEE dans les prises de décision de l‘entreprise relatives aux mesures proposées.

Abstimmung zwischen den Ebenen • EBR-Mitglieder brauchen entsprechende Rechte und Kommunikations-

wege um auf nationaler Ebene über den Inhalt und den Ausgang der EBR-Arbeit zu berichten. Wichtig, um die Arbeit des EBR in der örtlichen und nationalen Arbeitnehmerinteressenvertretung zu verankern.

appropriés pour informer sur le contenu et les résultats du CEE. Ceci est important pour ancrer le CEE dans les échelons national et local de la représentation des travailleurs.

Neue EBR-Richtlinie enthält wichtige Verbesserungen für die Arbeit vieler EBRs

● Obwohl die neue Richtlinie nicht grundsätzlich auf “Artikel-13-Vereinbarungen” angewendet werden kann, können diese EBRs politisch mit den neuen Standards arbeiten.

La directive CEE refondue contient d’importantes améliorations pour le travail de bon nombre de CEE

● Les CEE „Article 13“, bien qu’ils puissent être exemptés des nouvelles règles, peuvent et devraient néanmoins travailler politiquement avec les nouvelles règles.

The recast EWC Directive contains important improvements for the work of many EWCs

● “Article 13” EWCs may be exempt from the new rules, but they can and should still work politically with the new standards.


Artikel-6-EBRs● erhalten wichtige neue Ansprüche (es sei denn, ihre Vereinbarungen

wurden zwischen Juni 2009 & Juni 2011 abgeschlossen oder verändert)

● aber diese müssen evtl. vor Gericht eingeklagt werden.

CEE Article 6● gagnent des nouveaux droits importants (sauf si leurs accords ont été

signés ou amendés entre juin 2009 et juin 2011)

● Gesetz definiert “wesentliche Änderungen”, die zu Verhandlungen nach Art 13 neu führen;

● für EBRs, die 2009/38 anwenden können, gelten neue Definitionen direkt und

● bei Konsultation: Recht mit Leitung zusammenzukommen und Antwort zu erhalten
