If a gift is intended only for the temporary purpose of enriching a particular person or group of persons (associations), then the Foundation will be a permanent donation, in particular to indefinite persons, permanently or recurrently at certain times for the benefit of a material one Basic wealth. The characteristic of the foundation is therefore the charitable nature of the donation to certain purposes of welfare, charity, promotion of noble purposes. However, in order to secure the complex of assets and the preservation and use of abandonment for the future, organizational regulations are always necessary, a statute corresponding to the will of the founder, which also contains the conditions stipulated for the reception of benefits by the founder; in addition, foundations for adhering to the constitution of the foundation and finally the state approval of the establishment of the legal capacity of the foundation. After the? Meininger's Basic Law of 1829, Art. 35, foundations were free of annoying conditions, but the name of the founder was to be reported by the consistory to the sovereign. Alimony alike are rightfully respected in the law, they generally enjoy the same favor as those and no longer require prior approval by the Land. Requests to the spiritual lower courts and resp. As family scholarships there are the so-called large and small Ebenrettersche, the Klippersche, the Trentfußsche, the Koch-Lutzsche, the Schellersche, formerly also the Eberhardsche for descent from the founder of his own and his two Eheweiber families. As bourgeois scholarships: the Meistersche, the Bornausche, the Bierdümpfelsche and the Elffleinsche, which were united under the name of the bourgeois scholarship for student city children. The Witter and Röhrig Foundation. In the meantime Bierdümpfelsche is actually also a family scholarship and was only included in the bourgeoisie because of its lack of competitors who are still found, while the founders of the Koch-Lutzschen and Ebenretterschen expressly designated them for local bourgeois sons, if no competitor out of the named families would be present. The primary sources of scholarship were the local scholarship council files and auxiliary files to explain individual points, especially the scattered far-flung correspondences of the former General Superintendents Siegmund Bäsch (1751-56) and Philipp Kern (1759-1776) to ward off unjustified Foreigners who tried to force themselves into the perception and introduced better order in the scholarship system; Superint. The study period of the fellowship scholarships was, according to our records, usually a quinquennium between 1630 and 1790. The preparation for this gave the local council school for local citizens' sons. As these but before Rector Ad. This was followed by the admonition to an eager continuation of his studies and perseverance in a well-mannered way of life; the warning against the appropriation of immoral society, and especially of religious orders, whose impositions he had soon to report to the senate or vice-rector; finally, the condition that the stipulated triennium be fully tolerated and that it should not leave the university before it has passed without special permission obtained and received. Most of those who applied for scholarships earned their living by enslaving and copying booklets. As far as the application for the family scholarships is concerned, 125 years ago, when the relationships were almost unknown to everyone, the family trees submitted by petitioners were not always given to them. After many requests for help in 1855, they were returned and executed under their authority According to publications in the Government Gazette, the parish ministries were responsible for the births, copulations and deaths of 37 weekly collections. The address to the Council in 1702 was: "To those well-to-do, most honorable, grand-inquisitive, well-to-do, considerate, and benevolent mayors and councilors in the princely residence of Hildburghausen, to my most honored gentlemen and esteemed Pattonis." Petitions of that time are somewhat whimsical. One of them wrote from Coburg: "By the way, in addition to my entire family, in prayer before God, as in all things of the soul, I do not want to be short of this high favor against my well-to-do and gentlemen and dearly beloved relatives." Another to the Consistory 1760: "In the hope of just and urgent help, order Ew. The petitions were usually also written in Latin testimouia the professors enclosed in favor of the petition. Yes, on January 18, 1535, the request of a student Heurieus Ditteried von Hilperhausen himself advocated the rector of the University of Wittenberg, Johann Ernst Duke of Saxony, Landgras Jnn Düringen and Marggraff zu Meissen, because he had been credibly reported by Italian magistrates and doctors, that, at the same time, he was honestly and honestly waiting for his studies. "The news is sober and without much curiality, but the request for a report is made in the following form:" Those students who are among those below our collapse Fellowships, namely the Koch-Lutzsche, the two Ebenretterschen, the Klippersche, the Trentfußschc, the Bierdümpfelsche, the Schellersche, the bourgeois scholarships, the Röhrig Foundation for the academic year 190 to 190, to make claims within four weeks from today by applications in writing, in relation to F Amilienstipendien with enclosed certified Stammtaseln

resp. genealogical tables as evidence of the relationship with the founders in our case. Hildburghausen, den. February 190. The Magistrate. "The awarding of the scholarships is according to the foundation charters always to 3 years to" the next friend "; However, the competent persons have to register each year with proof that they are still active and that they are responsible for the foundation documents on faculty studies at a university (not studies at a technical or other university). The resolution of the Magistrate, which is taken to Michael with the help of Ephorus, is subject to confirmation by Herzogl. Ministry of State Dept. of Church and School Matters. After confirmation, the city council publishes: "The scholarship for the academic year under the collage of the city council. , have been distributed to the following students with the approval of the high authority, "

19 - while the city's brewing company had previously been instructed to pay said scholarships in exchange for proof that the recipients were aetu stuäeutes. For the presentation of family scholarships it is not necessary to submit assets. With regard to the collation law and distribution mode, the following is noted from earlier times. According to the foundation documents of the family scholarships, the right of collusion was undoubtedly due to the municipal authority, the magistrate, who had to distribute it annually to Palmarum in the presence of the superintendent, who scheduled the distribution. In fact, however, the consistory exercised the collapse for years, while the city council only had formal approval. Thus, constitutional orders, which could actually only extend to the supervision and approval of the Council's decisions, went to the Council according to the formula: "Our favorable will beforehand, especially good patrons! After this . , as we desire instead of and in the name of the Most Serene Lord and Lord, Duke of Saxony, Jülich, Cleve and Berg, also Engern and Westphalen, Ours graciously reigning sovereign and Lord We hereby ... This is what our opinion and we are to you inclined to favorable will. To the Prince Sächs. Consistorium anher prescribed presidents, councilors and assessors. "The council, however, wrote:" Ew. Ex. Have instructed us by aneaturation. " It was only in 1783 at the request of the Council for a detailed examination of Perceptionsberechtigung the Kollatur exclusive. of the v. Nimptschen and Klipperschen, who was administered by the elders of the family, were all referred to them with the assistance of the General Superintendent. However, there was no lack of dissidence from then on. In 1784, when the Council shortened a person who was more eligible for the Klipper scholarship, the consistory referred him to this "charge," but with the addition: "which, although you deserve it, you should not be charged for this time." In 1798 the Council was threatened that in case of arbitrary awarding of scholarships the aisis iustruets should be sent exteros by the Princely Fiscal for the preparation of a legal recognition. When, in 1801, the burgomaster claimed that Fürstl. Consistorium one percipient against others had been reset, a lengthy process of judicial process arose, whereby finally the magistrate had to pay in the comparison way because of its imposition also the costs. Thus, the council called the collation business "an annoying and annoying business," whereby he also had to accept many kinds of proposals from applicants.in fact, inter alia, the chamber councilor Buhl wrote in Coburg, March 14, 1798: "My lords! One partisanship on the other, that is not at all a matter of a Council College. You deserve such a behavior, of high authority of the

2931/5000 Page 20 Moreover, as a tutor and eollator, because of the delay in the collapse, the council was reminded by many of the "terrible things which he had to lay before God." When the City Council in 1807 had used the Eberhardt Scholarship to buy textbooks, the consistory wrote: "The arbitrariness and arbitrariness with which you have deviated from the purpose of the foundation can not be excused. The founder's family has a well-earned right to enjoyment, and according to it all equally deserving local bourgeois sons devote themselves to their studies; Through public announcements, you had to inform the students of the vacancy of the scholarship. "Then, as the magistrate protested, assuring that he would always go straight for distribution, and did not go by the wayside, the consistory replied. January 6, 1808: "Your report of the 16th of the month provides only proof that you have looked at the 9/11 recript from a wrong point of view, otherwise you would have a serious instruction for future compliance with the hitherto neglected order neither can it appear to be ill, nor mislead to the remark that rebuke of the kind might mislead you in the zeal which you owe to the good cause and the state. " Arbitrary was often the mode of distribution, both by the Consistory and the Council. So z. In 1775, for example, the consistorium ordered that the next relative should always be decisive in the awards, that the eomputation of the apex should first extend to every line of the tribe, since each tribe spreads out into many secondary lines, but always on the main line to reflect those who were closest to the testator (in the jus pereipieuei ex saFuiue yuaesitum the aiaeu pioximiores in front of the remotioiW). On the other hand, however, it was again looked at the neediness and that after the Prince. National Order I. e. 7 M. 1 the scholarships first and foremost country children (even with the same degree of relatives) would come to good and among these again after the Casimirian. K.-O. p. 213 especially poor pastor sons. Another time family grants were not given to blood donors of the founder, but to those who were only related by Schwägerschast. In addition, scholarships were often shared by the Council because the testator felt that as many students as possible should be helped.According to the Council of Jurisons of Sebastian Kobe, since 1747 there have been four privileged reasons for two equally valid competent lateral eollationism eomImtatioueu M-is eivilis Jan The older one goes to the younger one Feb Likewise, the one who is more likely to be registered and insurance

the lead. Since some received scholarships after they had left the university for a long time, with a reduction of still really students, the consistory in 1747 gave the magistrate the cessation of the covert abuses. The Council had acted in the well-intentioned opinion that many who had been forced to pay debts during their academic studies had to pay debts by promoting their domestic nature. The same consistory meant back in 1748 the same opinion, the son of the baker Mich. Schneyer "after completion of the current period of perceptions, the scholarship, if then no pioxiimor Araäu available, nor for three years to enjoy, if the same at that time should no longer be at universities." Only in 1775 was strictly ordered, scholarships only To pay those who really were at universities, who frequented LoUeAia, and who bore testimony of good conduct from their professors, but who were not allowed to issue the usual excuse-for-decent papers at all. The decision was s. Percipient once had to have the citizenship and to pass an exam before the Ephorus and a learned Ebenretter. In the absence of the testator's brother's sons, the scholarship came from the father to the elders of the family, so he studied, in the absence of his mother, friends and, failing that, students of the city of Hildburg, according to the will. In the case of competition, the one nearest in the degree, with the same proximity to the degree, had the advantage over the others who had previously obtained the university. The so-called small Ebenretter Scholarship donated in 1585 by Rector Simon Ebenretter in Windsheim was awarded in 1794 to city children for the procurement of textbooks. A certificate about the foundation is not available.

It would be, then, that such high schools should come into contempt and acceptance of learned men, if they should then turn to other high schools, which hold learned men to do their time well ordered, if one wishes to oppose such a thing to privilege and appease him or herself by all means of this mygthous legacy and scholarship. If one wanted to take it and not to consume such an interest in other schools at any high school, it should be completely abolished and not permitted. I also order and want that the main prescription of such appended 700 florins be kept well and in good safekeeping. e. Leger and I bring to my dear brother Michael Ebenretter and his children at Hildburghausen the Anspachs mills called in half the part, as those by inheritance and in parts fallen on me and come, with additions and enthrallments, so to half my belonging. k. I blame him for doing so because of the house I have given him to buy, and for that very purpose, to remember my best. I set and procure Balthasar's Bötzinger's and Ursula's conjugal housewives to my kindly beloved brother-in-law and sister in my field in Wolfsloch, to my beaker inside and out, and a golden lid to commemorate my dabey in the best. Item legire and I give my sister Margarethe soul. To two of my children, each leg I give and give to my cousin, Martin Ebenretter's son, George, 100 fl. and his sister 30 fl. studded belt to commemorate my dabey. As an item, I lay and arrange for my Weingarts men and their children a vineyard at Gobelschlen, which is structurally built so that they will remain unsold to their children and be kept in good condition for the benefit of named children. In addition, I put a bed-load, a under-bed, an over-bed, a straw sack, a P-feeler, two kisses and two Leylachen all with the best, as my testamentaries probably know to moderate their children. Item legire and I give Veit Brauern a silver in Magellein. I order and assert that every legatee who, in his legacy, if I bequeath to him and believe that he is not content, but ungratefully show himself against my testamentaries, will be deprived entirely of his legacy of his ingratitude and to use such for the benefit of poor people. I want that too, so some Page 29 My will and last will in part want to overturn or render incapacitated, by which my willfuls should keep it. Lastly, while the establishment of the heirs is a principal and cause of every last will and will, so in the very best and most consistent form and form of the right to my true, true, and undoubted heirs, I appoint and appoint a brother and sister dear to me Michael Ebenretter together with his children and Ursula Balthasar Bötzinger's marital housewife, as reported, in all and every possessions and goods, be it lying or moving, visited or unvisited, nothing excepted, so after payment of the debts and orientation of the legates described above and before it will be so, that my brother and his children should take half a share, and show themselves friendly and brotherly and sisterly in unity with one another, and commemorate in my prayer to God my poor soul. I order and wish that my appointed heirs should do my testamentary work in the exemption and execution of this last will in the least of not diminution or entry, but bite off all my possessions altogether, and much of my written testament and Last Will by my will to the wills oversupply willing and deliver. But if my heirs did so, they should be deprived of all the legates and affairs, as I meant them. And so that my will and last will be accomplished and enforced, I have arranged and appointed the honorable and well-honored, also honorable Hieronymus Geyssen and Georg Brauern of Würzburg, my most auspicious lords and friends, for the sake of God for my willful, executor and faithful asking to carry out my testament, Codicill and last will, according to his content, and to faithfully fulfill, as I set and have the heart and great confidence in them. For this reason, I give and give to each one of my tall silver cups one of whose dreys is best to commemorate my dabey. Protest and testify here publicly, where it should not have my business and ultimate will as a testament of omission of some ornament or glory of power and power, that after all it happens as every bad last will and business, so among the living by death Power and power have, subject to change my last will, to do several, even or partly. Item, for example, when pieces of paper are to be found by my command written in this last will of mine, I want them to be carried out by my testamentaries just as if they had been understood and written from word to word.
