INTRODUCTION
“Customer” is the physical or juridical person who, as a guest, makes a contract for a holiday and/or a “buying and selling” contract concerning a holiday package. Baia Holiday identifies the company C.V.M.I. srl located in Piazza Vittorio Emanuele II, 31 - Salò - Italy, VAT/Fiscal Code 01406260933, as an intermediary that manages booking requests and stipulates contracts for tourist stays in facilities managed by the Baia Silvella Group and its partners. “Tourist accomodation” is the society who manages the Baia Silvella Group resorts.
1. CONTRACT AND BOOKING The trabel contract consist of: the booking conditions, the description of the services contained in the booking proposal sent by Baia Holiday and what is indicated on the catalog and / or website of the chosen structure. Reservations can be sent to our address by TELEPHONE, post, fax or e-mail or completed directly from the Baia Holiday website https://booking.baiaholiday.com through an on-line booking system. Reservations are exclusively accepted for groups from a minimum of 1 to a maximum of 6 persons, of which at least 1 adult. Reservations are personal and exclusively valid for the persons whose personal data are indicated in the booking contract. On receiving the booking request, Baia Holiday will send the customer a “service quote/holiday package” which specifies: the chosen tourist accomodation, the accommodation unit and/or room or apartment, the arrival and departure dates, the amount outstanding at the time of the request, the deposit paying procedure (amount and expiration date) and the balance payment conditions. The quote must be fully verified, confirmed and signed by the customer, and returned by fax, mail or post. Any requests for services related to accommodation such as (maritime and / or naval transport), will be managed by Baia Holiday providing the customer with the booking class / rate defined by the shipping / shipping company and may be subject, for the individual transport service, booking conditions defined by the shipping / shipping company itself. If accepted by the customer, the unbundled services will not be configured as a negotiating case of travel organization or tourist package. Baia Holiday makes itself available, if necessary, to release to the customer all the documents relating to the unbundled service purchased (eg booking / cancellation conditions). By confirming the booking and/or by the payment of the deposit/ balance, the booking contract is to be considered binding. Baia Holiday considers the booking as confirmed only after having received the full deposit and/or balance. “Cliente” è intesa la persona fisica o giuridica che stipula un contratto di soggiorno turistico e/o un contratto di compravendita di pacchetto turistico, in quanto ospite. “Baia Holiday” identifica la società C.V.M.I. srl sita in Piazza Vittorio Emanuele II, 31 – Salò – Italia P.iva. e cod. fiscale 01406260933, quale intermediario che gestisce le richieste di prenotazioni e stipula contratti per soggiorni turistici nelle strutture ricettive gestite dal Gruppo Baia Silvella e suoi partner.“Struttura ricettiva” è la società che si occupa della gestione delle strutture ricettive del Gruppo Baia Silvella.

CONTRATTO E PRENOTAZIONE Costituiscono parte integrante del contratto di viaggio, oltre che le presenti condizioni di prenotazione, la descrizione dei servizi contenuta nella proposta di prenotazione inviata da Baia Holiday e quanto indicato sul catologo e/o sito web della struttura scelta.La prenotazione può essere effettuata e conclusa tramite telefono, posta, fax, e-mail, internet, presso i nostri recapiti, oppure direttamente dal sito web di Baia Holiday https://booking.baiaholiday.com tramite sistema di booking on-line. Il servizio di soggiorno è erogato esclusivamente a nuclei composti da un minimo di 1 ad un massimo di 6 componenti, dei quali almeno 1 maggiorenne. La prenotazione è nominativa, ed in quanto tale è ritenuta valida esclusivamente per le persone i cui dati personali sono indicati nel contratto di prenotazione. Al ricevimento della richiesta di prenotazione, Baia Holiday invia al cliente il preventivo dedicato nel quale sono indicati: la struttura ricettiva scelta, la tipologia di unità abitativa e/o piazzola e/o camera e/o appartamento, le date di arrivo e di partenza, il corrispettivo in essere al momento della richiesta dovuto per il soggiorno e le modalità di pagamento.Il preventivo deve essere confermato per accettazione secondo le modalità indicate nel preventivo stesso e si riterrà dunque accettato per contenuto, condizioni e regolamento della struttura scelta. Eventuali richieste per servizi correlati all’alloggio quali ad esempio (trasporto marittimo e/o navale), saranno gestite da parte di Baia Holiday fornendo al cliente la classe/tariffa di prenotazione definita dalla compagnia navale / marittima e potranno essere oggetto, per il singolo servizio di trasporto, di condizioni di prenotazione definite dalla compagnia navale / marittima stessa. Qualora accettati dal cliente, i servizi disaggregati non si configureranno come fattispecie negoziale di organizzazione di viaggio ovvero pacchetto turistico. Baia Holiday si rende disponibile, qualora necessario, a rilasciare al cliente tutti i documenti relativi al servizio disaggregato acquistato (es. condizioni di prenotazione / cancellazione).Con la conferma della prenotazione e/o il pagamento della caparra/saldo, si ritiene concluso il contratto di prenotazione dei servizi turistici, e come tale è vincolante. Unter der Bezeichnung “Kunde” versteht man jede natürliche oder juristische Person, welche (als Gast) einen Vertrag über einen touristischen Aufenthalt und/oder einen Kaufvertrag eines touristischen Pakets unterzeichnet.Als „Baia Holiday” bezeichnet man das Unternehmen C.V.M.I. “Baia Holiday” SRL mit Hauptsitz in Piazza Vittorio Emanuele II, 31 – Salò – Italien, MwSt.-Nummer 01406260933, das, als Reisevermittler Reservierungsanfragen bearbeitet und Verträge über touristische Aufenthalte in den von der Gruppe Baia Silvella geleiteten Unterkunftsanlagen abschließt. “Unterkunftsanlage” bezeichnet das Unternehmen, das für die Führung der Unterkunftsanlagen von der Gruppe “Baia Silvella” zuständig ist.
1. BUCHUNGSVERTRAG Diese allgemeinen Geschäftsbedingungen, alle Leistungsbeschreibungen der auf den von Baia Holiday geschickten Angebotsschreiben und alle auf der offiziellen Webseite und auf dem Katalog veröffentlichten Informationen sind Bestandteil des Buchungsvertrags. Buchungen können per Telefon, Post, Fax, E-Mail, Internet, persönlich auf unseren Camping Villages oder über die Website von Baia Holiday https://booking.baiaholiday.com mit dem Online-Buchungssystem durchgeführt werden. Der Aufenthalt ist für Gruppen von 1 bis maximal 6 Personen gestattet, wobei mindestens eines davon volljährig sein muss. Die Reservierung ist personenbezogen und nur gültig für die auf dem Buchungsvertrag angegebenen Personen. Nach Erhalt der Buchungsanfrage schickt Baia Holiday dem Kunden das „unverbindliche Angebot”, das folgende Angaben enthält: die Unterkunftsanlage, die Kategorie des Stellplatzes/Mobilheimes/ Zimmers/Ferienwohnung, das An- und Abreisedatum, der zum Zeitpunkt der Reservierungsanfrage gültige Gesamtbetrag und die Zahlungsbedingungen. Das „unverbindliche Angebot“ muss nach den auf dem Angebotsschreiben angegebenen Modalitäten angenommen werden. Mit der Annahme des Angebots wird bestätigt, dass der Angebotsinhalt, die Buchungsbedingungen und die Hausordnung der gebuchten Unterkunftsanlage akzeptiert werden. Die Anfragen für die damit verbundenen Reiseleistungen (z.B. Schifftransport) werden von Baia Holiday bearbeitet. Dem Kunden werden die Tarife und Klassen der jeweiligen Schifffahrtgesellschaft angeboten. Für die Buchungen von einzelnen Reiseleistungen/Transportleistungen gelten die Geschäftsbedingungen des jeweiligen Anbieters. Sollte der Kunde die Buchung annehmen, dann können die einzelne Reiseleistungen nicht als touristische Gesamtleistung oder Paket verstanden und in Anspruch genommen werden. Baia Holiday steht dem Kunden zur Verfügung, um alle Reiseunterlagen (z.B. Buchungs- und Stornobedingungen) zu übermitteln. Mit der Bestätigung der Buchung
