Según datos del Plan Territorial de Mallorca, unas 30.000 construcciones están fuera de ordenación en las Islas Baleares, cerca de 28.000 en Mallorca y 2.000 entre el resto de islas. Con la aprobación y desarrollo de la Ley de Or-denación y Uso del Suelo (LOUS) se produce una simplificación y racionalización del ordenamiento urbanístico y una agilización de los procesos de le-galización y tramitación de las licencias urbanísti-cas municipales. Se introduce también el régimen de comunicación previa para proyectos de obras sencillas, “obra menor”, y se sigue el principio del desarrollo sostenible, es decir, se respetan aspec-tos ambientales, económicos y de cohesión social.

Pero sin duda la medida estrella es la recogida en la disposición transitoria décima, por la que se es-tablece un procedimiento único y extraordinario de tres años para la legalización de construcciones en suelo rústico.

Also introduced is the system of prior Communications for projects of simple Works, “minor building”, and the principle of sustainable development is followed, in other words, environ-mental, economic and social cohesion aspects are respected.

But without a doubt the outstanding measure is that within the provisional tenth regulation, whe-rein is established a unique extraordinary proce-dure of three years in order to legalize buildings on rural land.

Laut Daten des Landesplans von Mallorca, circa 30.000 Gebäude stehen im Widerspruch zu den geltenden Bauvorschriften, davon 28.000 auf Ma-llorca und 2.000 auf den restlichen drei Inseln. Die Bewilligung und Entwicklung des Baugeset-zes (LOUS) bringt mit sich eine Vereinfachung und Rationalisierung der städtischen Bauordnung, welche die Legalisierungsverfahren und dazuge-hörige Abwicklung von gemeindlichen Baugeneh-migungen beschleunigt. Eingeführt wird auch ein Vorankündigungssystem für kleinere Bauprojekte. Die neue Regelung richtet sich nach dem Grund-satz der nachhaltigen Entwicklung, wobei umwel-tökonomische Aspekte sowie solche des sozialen Zusammenhalts berücksichtigt werden.

Doch zweifellos ist die Massnahme beinhaltet in der zehnten Übergangsbestimmung am wichtigs-ten, die ein einheitliches ausserordentliches Ver-fahren mit einer Dauer von drei Jahren festgelegt für die Legalisierung von Gebäuden errichtet auf landwirtschaftlichen Flächen.

El proceso de legalización se iniciará con la comu-nicación previa ó “licencia exprés” dirigida al Ayun-tamiento, siempre acompañada de un proyecto completo de actuación, que incluirá el presupuesto y el plazo de ejecución de la obra, nunca superior a dos años, y la justificación del cumplimiento de dichos requisitos mediante una declaración jurada.

Se podrán acoger al proceso de legalización las construcciones, tanto edificación principal como elementos de la finca, es decir, terrazas, sótanos, piscinas… en suelo rústico de antigüedad superior a 8 años, incluidas las levantadas en Áreas Natu-rales de Especial Interés (ANEI) anteriores a la Ley de Espacios Naturales de 1991. Será de obligado cumplimento la obtención de la cédula de habitabilidad, pagando las tasas e im-puestos previstos en la normativa de nuevas edifi-caciones, además de abonar al Ayuntamiento una sanción del 15% del coste de ejecución de la cons-trucción legalizada si se tramita el primer año, 20% el segundo año y 25% el tercer año.

Das Legalisierungsverfahren wird mit der Sen-dung einer vorherigen Mitteilung oder "Express-Genehmigung" an die Gemeinde gestartet, wel-che ausnahmslos ein vollständiges Bauprojekt inklusive eines Kostenvoranschlages und Anga-ben bezüglich des Ausführungszeitplans (maximal zwei Jahre), sowie eine eidestattliche Erklärung zur Rechtfertigung der Erfüllung aller Anforderungen beinhalten muss.

Von der Möglichkeit eines Legalisierungsver-fahrens werden alle Liegenschaften -betro-ffen sind nicht nur das Hauptgebäude, sondern auch weitere Bestandteile der Liegenschaft, wie zum Biespiel Terrassen, Kellerräume, Swimming Pools...- gebaut auf landwirtschaftlichen Flächen, die über 8 Jahre alt sind profitieren können, inklu-sive jene gebaut in Naturgebieten von besonde-rem Interesse (ANEI) vor dem Inkrafttreten des Gesetzes über Naturgebiete aus dem Jahr 1991.Sowohl die Beschaffung der Bewohnbarkeitsbes-cheinigung als auch die Zahlung von Gebühren und Steuern vorgesehen in den Bauvorschriften für Neubauten sind verpflichtend. Ferner wird eine Geldstrafe fällig und zahlbar an die Gemeinde, de-ren Höhe zwischen 15% der Baukosten der lega-lisierten Liegenschaft im ersten, 20% im zweiten und 25% im dritten Jahr variiert.

En definitiva se podrán legalizar aquellas construi-das antes de 1991 en suelo protegido por la Ley de Espacios Naturales y aquellas existentes en suelo rústico a las que no se les puede aplicar el res-tablecimiento de la legalidad urbanística (demoli-ción) por prescripción de la infracción, esto es un plazo de 8 años.

Para el cálculo del plazo de la prescripción de la infracción se debe tomar la fecha de entrada en vigor de la LOUS, es decir el 29 de marzo de 2014. Por lo tanto se podrán legalizar las construcciones en suelo rústico existentes con anterioridad al 29 de marzo de 2006.

Letzendlich werden Bauwerke legalisiert, die vor 1991 auf durch das Gesetz über Naturgebiete ges-chützten landwirtschaflichen Flächen gebaut wur-den, und solche, die auf Agrarland errichtet wur-den und nach Ablauf einer 8 jährigen Frist wegen Verjährung nicht mehr zum Abriss zwecks Wieder-herstellung der städtebaulichen Legalität verurteilt werden können.

Das Verjährungsdatum der Bauordnungswidri-gkeit wird in Verhältnis zum Datum des Inkraft-tretens des Baugesetzes (LOUS), d.h. ab dem 29. März 2014, berechnet. Dementsprechend werden alle auf landwirtschaflichen Flächen existierenden Bauten die aus der Zeit vor dem 29. März 2006 datieren legalisiert werden können.
