Die Anforderungen an Zentrifugen in Medizin, Wissenschaft,Forschung und Technik steigen ständig.

Viele Anwendungen erfordern Zentrifugen mit besonderenLeistungsmerkmalen und spezieller Ausstattung.

Nicht selten gestaltet sich die Suche nach der geeignetenZentrifuge aber schwierig, weil kein übersichtliches Informa-tionsmaterial zur Verfügung steht.

Mit diesem Katalog erhalten Anwender aus den verschiedenstenBereichen ein Instrument, mit dem sie die Zentrifuge auswählenkönnen, die ihre Anforderungen voll und ganz erfüllt.

Der Aufbau des Katalogs

Auf Kurzbeschreibungen der einzelnen Zentrifugenmodelle fol-gen die physikalischen Angaben und die Bestelldaten des jewei-ligen Zubehörs in übersichtlicher, tabellarischer Form.

Diese Tabellen führen den Leser von der Anwendung, d.h. vomgewünschten Gefäß zum passenden Zubehör.

Sind die Gefäße, die benötigte Geschwindigkeit (RCF) undTemperatur bekannt, können also die passenden Gehänge,Einsätze und Rotoren mühelos in den entsprechenden Spaltender Bestelldaten abgelesen werden.

Die Spalte „Gefäße pro Rotor“ nennt stets die maximale Anzahl,die mit dem angegebenen Zubehör in den jeweiligen Rotor ein-gesetzt werden kann.

Mit der Zielsetzung, den Katalog anwenderfreundlich und hand-lich zu gestalten, wurde nicht alles Zubehör abgebildet. Die Dar-stellungen beschränken sich daher hauptsächlich auf dieZentrifugen und die Rotoren.

Selbstverständlich stehen nach wie vor auch ausführliche Einzel-prospekte zur Verfügung.

What is the benefit of the catalogue?

The demands on centrifuges in industry, clinical chemistry, sci-ence, and research are growing constantly.

Many applications call for centrifuges with special performanceand particular accessories.

Often, finding the right equipment is difficult, because clearly pre-sented information is scarce.

The Hettich catalogue provides users of the most various fieldswith a tool that enables them to select the centrifuge that fullymeets their requirements.

How to read the catalogue

Short descriptions of the centrifuge models are followed by clear-ly arranged tables of physical data and suitable accessories.

The tables guide the reader from the required centrifuge tubes,plates, capillaries, etc. to the fitting accessories.

So, when the tubes, the speed (RCF) and the temperature areknown, the suitable suspensions, adapters and rotors can be easi-ly gathered from the columns representing the ordering informa-tion.

The column „tubes per rotor“ always states the maximum numberof tubes the rotor accepts with the indicated accessories.

With the objective to make the catalogue as handy and user-friendly as possible, illustrating all accessories was out of thequestion. Therefore, only pictures of centrifuges and rotors havebeen included.

Of course, detailed brochures on the individual centrifuge modelscontinue to be available.

Der 4 - fach Rotor Bestell -Nr. 1624 ist besonders für Laborsgeeignet, die nicht ausschließlich zytologisch tätig sind.Ohne Rotorwechsel können sowohl Röhrchen zentrifu-giert als auch zytologische Präparate hergestellt werden.Einfaches Austauschen der Gehänge genügt.In diesem Rotor können die Zyto -Becher Bestell -Nr. 1660und Bestell -Nr.1680 zentrifugiert werden.

Für das zytologische Labor dagegen empfehlen sichunsere Rotoren Bestell -Nr.1626 und Bestell -Nr.1648.Diese beiden Rotoren sind ausschließlich für dieZytologie entwickelt worden.

Das Datendokumentationssystem HETTINFO zeichnet alleZentrifugationsdaten auf. Es besteht aus kombinierbaren Modulen und lässt sich des-halb bequem an die Anzahl der benötigten Zentrifugenanpassen.

Der Anwender bestimmt weitgehend selbst, welche Datenaufgezeichnet werden. Ein Computer verwaltet maximal 29 Zentrifugen. Die Daten erscheinen auf dem Bildschirm in tabellarischerForm und stehen als Access ®#-Datenbank sowie als ASCII-Datei einem übergeordneten Rechner zur Verfügung.

HETTINFO – simply safer

The HETTINFO data report system records all centrifugingdetails. It consists of a combination of modules that easilyadapts to any given location and number of centrifuges.

One PC can control as many as 29 centrifuges. For the mostpart the users determine the data to be recorded themselves.

On the screen the data is presented in charts. To the hostsystem it is available in Access ®# or ASCII databases.

Allgemeine Geschäftsbedingungen

I. Geltung der Bedingungen und Nebenabreden

1. Alle Aufträge werden nur zu den nachfolgenden Bedingungen ange-nommen und ausgeführt. Gleiches gilt auch für Folgeaufträge, ohne dasses eines zusätzlichen besonderen Hinweises auf diese Bedingungenbedarf. Mit Auftragserteilung erkennt der Käufer diese Bedingungen alsrechtsverbindlich an. Die Lieferung durch den Verkäufer bedeutet keineZustimmung zu entgegenstehenden Bedingungen des Käufers.

2. Abweichungen von den gegenständlichen Bedingungen sowie Ände-rungen und Ergänzungen des Vertrages bedürfen zu ihrer Wirksamkeitder schriftlichen Bestätigung des Verkäufers.

II. Zustandekommen und Inhalt von Verträgen

1. Verkaufsangebote sind freibleibend. Ein Vertrag kommt erst dannzustande, wenn der Verkäufer schriftliche Auftragsbestätigung erteilt, diefür den Umfang der Leistungspflicht maßgeblich ist.

2. Die Ausführung eines Vertrages erfolgt nach Maßgabe der Modelle,Pläne, Abbildungen, Zeichnungen und sonstigen Unterlagen des Verkäu-fers. Sämtliche Verkaufsunterlagen bleiben im Eigentum des Verkäufersund sind urheberrechtlich geschützt. Vorgenannte Gegenstände dürfenohne Zustimmung des Verkäufers weder vervielfältigt noch Dritten zu-gänglich gemacht werden. Auf Verlangen - falls ein Auftrag nicht erteiltwird, auch unaufgefordert - sind sie an den Verkäufer kostenfrei heraus-zugeben.

3. Falls nach Vertragsabschluss durch ständige Weiterentwicklungen desVerkäufers technische Änderungen an den Produkten eintreten, darf derVerkäufer die technisch veränderte Ausführung liefern. Abweichungenvon Abbildungen, Zeichnungen, Beschreibungen, Farben, sowie Maß-,Gewichts-, Qualitäts- u. sonstigen Angaben sind zulässig, soweit sie unterBerücksichtigung der Interessen der Vertragspartner dem Käufer zumut-bar sind. Bei Massenartikeln kann die bestellte Gesamtmenge um 10 %über- oder unterschritten werden.

4. Erfolgt Bestellung nach Zeichnungen und Mustern des Bestellers stehtdieser dafür ein, dass Schutzrechte Dritter nicht verletzt werden. Der Be-steller stellt den Verkäufer im Übrigen von allen Ansprüchen im Innenver-hältnis frei, die sich aus einer etwaigen Verletzung von SchutzrechtenDritter ergeben.

5. Der Verkäufer kann Teilleistungen erbringen und deren gesonderteBezahlung verlangen.

III. Lieferfristen

1. Lieferfristen, die vertraglich vereinbart sind, setzen den rechtzeitigenEingang sämtlicher vom Käufer zu beschaffenden Unterlagen, Genehmi-gungen und Informationen voraus, die zur ordnungsgemäßen Durch-führung des Auftrages erforderlich sind. Auch ist der Besteller verpflich-tet, seine vertraglichen Verpflichtungen zu erfüllen - etwa fällige Zahlun-gen, auch aus früheren Lieferungen.

2. Die Lieferfrist beginnt erst dann, wenn die Voraussetzungen des Ab-satzes 1 erfüllt sind.

3. Die Lieferfrist ist dann eingehalten, wenn die Ware vor Fristablauf zumVersand gebracht oder dem Käufer abholbereit gemeldet ist.

IV. Lieferverzug und Unmöglichkeit

Falls der Verkäufer durch grob fahrlässiges Verhalten in Verzug gerätoder Leistung unmöglich wird, werden etwaige Schadenersatzansprücheauf die Zahlung von 5 % des vertragsgegenständlichen Lieferwertes be-schränkt, sofern keine gesetzlichen Vorschriften entgegenstehen.

V. Annahmeverzug des Käufers

Gerät der Käufer in Annahmeverzug, stehen dem Verkäufer die gesetz-lichen Rechte zu.

VI. Versand

1. Der Versand erfolgt auf Gefahr und Kosten des Käufers. Die Gefahrgeht mit dem Zeitpunkt der Übergabe an einen Spediteur durch den Ver-käufer über. Gleiches gilt, wenn der Verkäufer dem Käufer Abholbereit-schaft erklärt hat. Im letzteren Fall verwahrt der Verkäufer nach Ablauf derFrist für den Käufer. Der Verkäufer ist berechtigt, ein angemessenesLagergeld zu erheben. Zur Versicherung der abholbereiten Ware ist derVerkäufer nicht verpflichtet.

2. Der Abschluss einer Transportversicherung ist Sache des Käufers.

3. Der Verkäufer berechnet die Verpackung, die nicht zurückgenommenwird.

VII. Untersuchungs-, Abnahme- und Rügepflichten des Käufers

1. Der Käufer hat das Versandgut nach Eingang bei ihm sofort zu unter-suchen und etwaige Mängel spätestens innerhalb einer Woche nachErhalt der Ware schriftlich anzuzeigen. Unterbleibt die rechtzeitige Rüge,gilt die Lieferung als mangelfrei.

VIII. Mängelhaftung

Die Haftung der Mängel einschließlich fehlender zugesicherter Eigen-schaften bestimmt sich wie folgt:

1. Mängel, die innerhalb von 12 Monaten nach Ablieferung auftreten,nachweisbar bereits vor Gefahrenübergang vorlagen, werden nach Wahldes Verkäufers unentgeltlich nachgebessert oder durch Ersatzlieferungbeseitigt. Ausgetauschte Teile gehen in das Eigentum des Verkäufersüber. Der Verkäufer haftet nicht für Mängel und deren Folgen, die verur-sacht werden durch natürlichen Verschleiß, unsachgemäße Behandlung,Eingriffe des Käufers oder Dritter sowie chemischer, elektronischer odersonstiger Einflüsse, soweit ihnen das Produkt nicht aufgrund der vertrag-lichen Vereinbarung ausgesetzt werden darf.

2. Ein festgestellter Mangel ist unverzüglich, spätestens 1 Woche nachdessen Entdeckung dem Verkäufer anzuzeigen. Zur Beseitigung desMangels hat der Käufer dem Verkäufer eine angemessene Frist zu ge-währen, anderenfalls ist der Verkäufer von der Gewährleistung frei.

3. Sind vom Verkäufer verwendete Fremderzeugnisse fehlerhaft, kann derKäufer die gegen den Verkäufer bestehenden Gewährleistungsrechteerst durchsetzen, wenn er unter Fristsetzung versucht hat, Gewährlei-stungsansprüche unmittelbar bei den Vorlieferanten des Verkäufersaußergerichtlich geltend zu machen. In einem solchen Falle ist der Ver-käufer verpflichtet, die diesem gegenüber dem Vorlieferanten bestehen-den Ansprüche abzutreten.

4. Bei Fertigung nach Zeichnung des Bestellers beschränkt sich die Ge-währleistung des Verkäufers auf zeichnungsgerechte Ausführung. Für dieFunktionsfähigkeit des Endproduktes haftet der Verkäufer nicht. BeiLösung von Konstruktionsaufgaben im Rahmen des Auftrages des Be-stellers beschränkt sich die Gewährleistung darauf, dass die Erzeugnissedes Verkäufers dem allgemeinen Stand der Technik entsprechen.

IX. Freizeichnung sonstiger Gewährleistungs- und Schadenersatz-ansprüche

Jede weitergehende Mängelhaftung sowie Schadenersatzansprüche desKäufers gegen den Verkäufer werden ausgeschlossen. Falls den Verkäu-fer grobes Verschulden trifft, oder eine zugesicherte Eigenschaft fehlt,beschränkt sich ein etwaiger Schadenersatzanspruch auf 5 % des Liefer-wertes lt. Rechnung. Es sei denn, dass zwingende gesetzliche Vorschrif-ten eine andere Regelung vorsehen.

X. Verjährung von Ansprüchen des Käufers

Die Ansprüche aus Mängelhaftung verjähren in 12 Monaten vom Zeit-punkt der Ablieferung an. In der gleichen Frist verjähren Schadenersatz-ansprüche, die auf Mängeln und deren Folgen beruhen. Andere Scha-denersatzansprüche - etwa aus Verschulden bei Vertragsabschluss - ver-jähren innerhalb von 12 Monaten nach Gefahrenübergang.

XI. Preise und Zahlungsbedingungen

1. Die Preise verstehen sich nach der zum Zeitpunkt der Auslieferung gel-tenden Listenpreise des Verkäufers ab Versendungsort. Fracht, Ver-packung, etwaige Versicherungen und sonstige Nebenkosten hat derKäufer zu tragen. Die Mehrwertsteuer wird in der jeweils gesetzlich gel-tenden Höhe gesondert berechnet.

2. Zahlungen sind bar oder per Überweisung frei Zahlstelle desVerkäufers zu leisten. Die Zahlung ist bewirkt, sobald der Verkäufer überden Betrag endgültig verfügen kann. Scheck, Wechsel oder sonstigeZahlungsmittel werden nur erfüllungshalber entgegengenommen. Diskont-, Wechsel- und Bankspesen gehen zu Lasten des Käufers.

3. Zahlungen sind sofort und ohne jeden Abzug nach Erhalt der Rech-nung fällig. Ein Abzug von Skonti oder Rabatten bedarf in jedem Falleeiner vorherigen schriftlichen Vereinbarung.

5. Bei vertragswidrigem Verhalten des Käufers - insbesondere Zahlungs-verzug - ist der Verkäufer berechtigt, die Vorbehaltsware zurückzuneh-men oder ggf. Abtretung der Herausgabeansprüche des Käufers gegenDritte zu verlangen. In der Zurücknahme sowie in der Verpfändung derVorbehaltsware durch den Verkäufer liegt - soweit nicht das Verbraucher-kreditgesetz Anwendung findet -kein Rücktritt vom Vertrag.

XIII. Werkzeuge und Sondereinrichtungen

1. Fertigt der Verkäufer Sonderwerkzeuge und Sondereinrichtungen an,bleiben diese auch dann in seinem Eigentum, wenn die Kosten in derRechnung ganz oder teilweise gesondert ausgewiesen sind.

2. Stellt der Käufer Werkzeuge zur Erledigung des Auftrages zur Verfü-gung, haftet der Verkäufer nach den Regeln über die unentgeltliche Ver-wahrung. Nach Ablauf von 5 Jahren hat der Verkäufer das Recht zur Ver-schrottung bei Ersatzpflicht, sofern während dieser Zeit keine Teile abge-nommen werden.

XIV. Haftung für Kundenmaterial

1. Stellt der Käufer zur Be- oder Verarbeitung Material zur Verfügung, haf-tet der Verkäufer bei Be- und Verarbeitungsschäden nur dann, wenn ihmgrobe Fahrlässigkeit zur Last fällt, jedoch nur bis zur Höhe von 10 % desBearbeitungswertes, es sei denn, dass zwingende gesetzliche Vorschrif-ten eine unbegrenzte Haftung vorsehen.

2. Das Material des Käufers wird bis zur Verarbeitung durch den Verkäu-fer nach den Regeln unentgeltlicher Verwahrung gelagert.

XV. Montage

Montagen, Reparaturen und Wartungsdienste werden nach den dafürgeltenden Bestimmungen des Verkäufers ausgeführt.

XVI. Gerichtsstand und anwendbares Recht

1. Ist der Besteller Vollkaufmann, eine juristische Person des öffentlichenoder privaten Rechts, gilt als Gerichtsstand der Firmensitz desVerkäufers als vereinbart.

2. Für Rechtsstreitigkeiten gilt das Recht der Bundesrepublik Deutschland.

XII. Eigentumsvorbehalt

1. Bis zur Erfüllung aller Forderungen (einschließlich sämtlicher Saldofor-derungen aus Kontokorrent), die dem Verkäufer aus jedem Rechtsgrundgegen den Käufer jetzt oder künftig zustehen, werden dem Verkäufer diefolgenden Sicherheiten gewährt, die er auf Verlangen nach seiner Wahlfreigeben wird, soweit ihr Wert die Forderungen um mehr als 20 % über-steigt.

2. Die Ware bleibt Eigentum des Verkäufers. Verarbeitung oder Umbil-dung erfolgen stets für den Verkäufer als Hersteller, jedoch ohne Ver-pflichtung für ihn. Erlischt das (Mit-)Eigentum des Verkäufers durchVerbindung, so wird bereits jetzt vereinbart, dass das (Mit-)Eigentum desKäufers an der einheitlichen Sache wertanteilsmäßig (Rechnungswert)auf den Verkäufer übergeht. Der Käufer verwahrt das (Mit-)Eigentum des Verkäufers unentgeltlich.Ware, an der dem Verkäufer (Mit-)Eigentum zusteht, wird im folgenden alsVorbehaltsware bezeichnet.

3. Der Käufer ist berechtigt, die Vorbehaltsware im ordnungsgemäßenGeschäftsverkehr zu verarbeiten und zu veräußern, solange er nicht inVerzug ist. Verpfändungen oder Sicherungsübereignungen sind unzuläs-sig. Die aus dem Weiterverkauf oder einem sonstigen Rechtsgrund (Ver-sicherung, unerlaubte Handlung) bezüglich der Vorbehaltsware entste-henden Forderungen (einschließlich sämtlicher Saldoforderungen ausdem Kontokorrent) tritt der Käufer bereits jetzt sicherungshalber in vollemUmfang an den Verkäufer ab. Der Verkäufer ermächtigt ihn widerruflich, die an den Verkäufer abgetretenen Forderungen für dessen Rechnung imeigenen Namen einzuziehen. Diese Einziehungsermächtigung kann nurwiderrufen werden, wenn der Käufer mit seinen Zahlungsverpflichtungennicht ordnungsgemäß nachkommt.

4. Bei Zugriffen Dritter auf die Vorbehaltsware wird der Käufer auf das Eigentum des Verkäufers hinweisen und diesen unverzüglich benach-richtigen.

5. The vendor shall be entitled to make part-deliveries and to demandseparate payment of such deliveries.

III. Delivery Terms

1. Contractually agreed delivery terms shall presuppose prompt receipt ofall documents, licences and information to be acquired by the purchaserand which are necessary for a proper execution of the purchase order. Thepurchaser shall also be obliged to have performed its contractual obliga-tions – for example, remittance of all due payments, including paymentsfor previous deliveries.

2. Delivery terms shall only commence when the prerequisites of para-graph 1 above have been met.

3. Delivery terms shall be deemed as having been complied with if thegoods are despatched prior to the delivery date or if the purchaser hasbeen notified that the goods are ready for collection.

IV. Delivery Delays and Impossibility of Supply

If the vendor defaults on delivery, or if performance is rendered impossi-ble, due to gross negligence on the part of the vendor, any compensationclaims shall be limited to 5 % of the contracted sales value unless other-wise provided by law.

V. Default of Acceptance by the Purchaser

The vendor shall be entitled to its legal rights if the purchaser defaults on acceptance of deliveries.

I. Applicability of Conditions and Ancillary Agreements

1. All purchase orders shall only be accepted and executed on the followingconditions. This shall also apply to subsequent orders without any specialadditional reference to the present conditions being required. With the placement of a purchase order, the purchaser shall be legally bound to thepresent conditions. Delivery by the vendor shall not constitute its agree-ment with conflicting conditions of the purchaser.

2. Any deviations from the present conditions, as well as any modificationsor amendments of the contract, shall require the written confirmation ofthe vendor in order to be valid.

II. Existence and Contents of Contracts

1. Sales quotations shall be subject to change without notice. A contractshall only exist if the vendor has issued a written order acknowledgementwhich is conclusive for the scope of the performance obligation.

2. Contracts shall be executed in accordance with models, plans, designs,drawings and other documents of the vendor. All written sales documentsshall remain the property of the vendor and shall be protected by copy-right. The aforesaid documents shall neither be copied nor made availableto any third party without the consent of the vendor. They shall be returnedfree of charge to the vendor on request – and automatically if no purchaseorder is placed.

3. If products are subject to technical modifications as a result of furtherdevelopments achieved by the vendor following the conclusion of a con-tract, the vendor shall be entitled to supply the technically modified ver-sion. Deviations from designs, drawings, specifications, colours and dimen-sions, weights, quality and any other details shall be permitted if they arereasonable for the purchaser and are in the interests of the contracting par-ties. Supplies of mass-produced articles may deviate from the orderedquantity by plus/minus 10 %.

4. The purchaser shall be liable for third party patent rights not being infring-

as conditional payment.Discount, bill of exchange and bank charges shall be borne by the pur-chaser.

3. Payments shall be due within 30 days of the invoice date, net.

4. Payments shall be in arrears after 30 days of the invoice date without aspecial reminder being required. Default interest shall be charged at 3 %above the current discount rate of the European Central Bank, but at aminimum of 8 %.The right to substantiate higher damages shall be reserved.

XII. Reservation of title, is amended as follows:

1. Until the fulfilment of all present and future outstanding claims (includ -ing all unpaid balances on current account) which the vendor has uponthe purchaser for any legal reason, the vendor shall be granted the follow-ing surety which it will release upon request and at its discretion if thevalue thereof exceeds the claims by more than 20 %.

2. The goods shall remain the vendor’s property. They shall always be pro-cessed or reworked for the vendor in its capacity as the manufacturer butwithout any obligation on its part. If the vendor’s (joint) title is annulled bycombination with other items, it is hereby agreed that the purchaser’s(joint) title to the single item shall be assigned to the vendor to the pro-portionate value (invoiced value). The purchaser shall safeguard the ven-dor’s (joint) title without charge. Goods to which the vendor has (joint)title are referred to hereinbelow as ”retained goods”.

3. The purchaser may process and dispose of the retained goods in thenormal course of business, provided that it is not in default. Pledging orassignment as security is not permitted. The purchaser hereby assigns tothe vendor as security all claims (including all unpaid balances on currentaccount) created by the resale or by another legal reason (insurance, tor-tious act) pertaining to the retained goods. The vendor gives it irrevocableauthority to collect the claims assigned to the vendor in its own name andfor the vendor’s account. The authority to collect those claims may bewithdrawn only if the purchaser does not duly fulfil its payment obliga-tions.

4. If third parties attach the retained goods, the purchaser shall indicate thevendor’s title and immediately notify the vendor.

5. Should the purchaser infringe the contract – especially in the event ofdefault in payment, the vendor may take back the retained goods or, ifappropriate, demand assignment of the purchaser’s rights to claim restora-tion from third parties. The taking back and the pledging of the retainedgoods by the vendor shall not imply withdrawal from the contract, unlessthe German Consumer Credit Law applies.

XIII. Tooling and Special Equipment

1. If the vendor produces special tooling and equipment, the vendor shallalso retain the ownership of such even if they are wholly or partially chargedto the purchaser.

2. If the purchaser makes tooling available for the execution of the purchaseorder, the vendor shall be obliged to keep such tooling carefully in its pos-session free of charge. After 5 years, the vendor shall be entitled to dis-pose of such tooling while compensating purchaser if no additional partshave been purchased during this period.

XIV. Liability for Customer Material

1. If the purchaser provides material for servicing or processing, the vendorshall only be liable for any servicing or processing damages in the event ofgross negligence but with a maximum of 10 % of the servicing or process-ing value unless mandatory law provides for unlimited liability.

2. The material of the purchaser shall be stored free of charge until it is pro-cessed.

XV. Installation

Any installation, repairs and maintenance services shall be carried out inaccordance with the relevant conditions of the vendor.

XVI. Venue and Applicable Law

1. The registered office of the vendor shall apply if the purchaser is a reg-istered trader or a legal entity under public or private law.

2. Any and all legal disputes shall be subject to the laws of the FederalRepublic of Germany.

VI. Despatch and Transfer of Risk

1. Goods shall be despatched at the risk and cost of the purchaser. The riskshall pass to the purchaser when goods are transferred to a forwarder bythe vendor. This shall also apply if the vendor has notified the purchaserthat goods are ready for collection.In the latter case, the vendor shall keep such goods on behalf of thepurchaser after the agreed collection date. The vendor shall be entitled tocharge reasonable storage costs.The vendor shall not be obliged to insure goods ready for collection.

2. The purchaser shall be responsible for arranging transport insurance.

3. The vendor shall make a charge for non-returnable packaging.

VII. Inspection and Acceptance Obligations of the Purchaser and Requirement to Give Notice of Defects

1. The purchaser shall be obliged to carry out an immediate inspection ofincoming goods and to notify any defects in writing within one week ofreceipt of the goods at the latest. Deliveries shall deemed to be free of anyand all defects if notice of such defects is not issued on time.

VIII. Liability for Defects

Liability for defects, including the absence of any warranted qualities, shallbe determined as follows:

1. Defects arising within 12 months of delivery or which can be shown tohave existed prior to the transfer of risk shall, at the option of the vendor,be rectified free of charge or replaced by alternative goods. Any replacedparts shall become the property of the vendor.The vendor shall not be liable for any defects and their consequenceswhich are caused by natural wear and tear, improper handling, interven-tions by the purchaser or third parties and chemical, electronic or any otherinfluences unless the product could be exposed to the aforesaid influencesby virtue of the contractual agreement.

2. Any established defects shall be notified to the vendor immediately butnot later than 1 week after their discovery.The purchaser shall be required to give the vendor a reasonable period ofgrace in which to rectify the defect, otherwise the vendor shall be exemptfrom any guarantee performance.

3. If third party materials used by the vendor are defective, the purchasershall not be entitled to enforce existing guarantee rights against the vendoruntil the vendor has endeavoured to enforce an out-of-court settlement ofits guarantee claims directly with its subcontractor within a specific period.In such cases, the vendor shall be obliged to assign its rights against the sub-contractor to the purchaser.

4. If goods are manufactured according to drawings provided by thepurchaser, the guarantee performance of the vendor shall be limited to theexecution of the purchase order in accordance with the said drawings. Thevendor shall not be liable for the proper working order of the end product.

IX. Exoneration from Any Other Guarantee and Compensation Claims

All further liability for defects or compensation claims of the purchaseragainst the vendor shall be excluded. If the vendor is guilty of gross negli-gence, or if a warranted quality is missing, any compensation claim shall belimited to 5 % of the sales value as per the relevant invoice, unless other-wise provided by mandatory law.

X. Limitation of Claims of the Purchaser

Claims arising from liability for defects shall be statute-barred 6 monthsafter the date of delivery. Compensation claims based on defects and theirconsequences shall also be statute-barred on the same date. Other com-pensation claims - e.g. negligence in contracting – shall be statute-barred12 months after the passing of risk.

XI. Price and Payment Conditions

1. Prices shall be based on the current price list of the vendor at the timeof delivery, ex place of consignment. Freight, packaging, insurance and any other ancillary costs shall be borneby the purchaser.Value-added tax – if relevant - shall be charged at the applicable rate.

2. Payments shall be made in cash, by transfer or by cheque free of chargesto the account designated by the vendor. Payment shall be deemed aseffected as soon as the vendor has access to the payment amount. Bills ofexchange, cheques and any other form of payment shall only be accepted
