Die Stadt Fürth erlässt auf Grund von Art. 23 der Gemeindeordnung für den Freistaat Bayern in der Fassung der Bekanntmachung vom 22.08.1998 (GVBl. S. 796, BayRS 2020-1-1-I), zuletzt geändert durch Gesetz vom 28.03.2000 (GVBl. S. 136) und der §§ 142, 143 des Baugesetzbuches in der Fassung der Bekanntmachung vom 27.08.1997 (BGBl. I. S. 2041) zuletzt geändert durch Gesetz vom 17.12.1997 (BGBl. S. 2041), zu-letzt geändert durch Gesetz vom 17.12.1997 (BGBl. S. 3108), folgende Satzung über die förmliche Festlegung des Sanierungsgebietes „Innenstadt“: § 1 Festlegung des Sanierungsgebietes 1Im nachfolgend näher beschriebenen Gebiet liegen städtebauliche Missstände vor. 2Dieser Bereich soll durch städtebauliche Sanierungsmaßnahmen verbessert oder um-gestaltet werden. 3Das Gebiet wird hiermit förmlich als Sanierungsgebiet festgelegt und erhält die Bezeichnung „Sanierungsgebiet Innenstadt“. 4Das Sanierungsgebiet besteht aus folgenden Grundstücken der Gemarkung Fürth in den nachfolgend genannten Teilgebieten:

5Werden innerhalb des Sanierungsgebietes durch Grundstückszusammenlegungen Flurstücke aufgelöst und neue Flurstücke gebildet oder entstehen durch Grundstücks-teilungen neue Flurstücke, sind auf diese insoweit die Bestimmungen dieser Satzung anzuwenden. 6Das Sanierungsgebiet umfasst alle Grundstücke und Grundstücksteile innerhalb der im Lageplan M. 1 : 2000 des Stadtplanungsamtes vom 28. November 2016 abgegrenzten Fläche. 7Dieser ist Bestandteil dieser Satzung und als Anlage bei-gefügt. § 2 Verfahren
1. In den Sanierungsteilgebieten Ib „Am Gänsberg“ II „Innerstädtische Freiflächen“, III „Gustavstraße“ IV „Rednitzhof“ V „Helmplatz“ VI „Umfeld Jüdisches Museum“, VII „Kohlenmarkt“, VIII „Angerstraße“ IX „Theaterstraße“, X „Innenstadt“, XI a – XI h „Rand- und Ergänzungsflächen“, XII „Bahnhofplatz und Hallplatz“, XIII „Cadolzburger Straße – Scherbsgraben“, XIV „Nördlich der Dr.-Max-Grundig-Anlage“, XV „Südlich der Dr.-Max-Grundig-Anlage“ XVI „Zwischen Kirchenstraße und Luisenstraße XVII „Gebhardtstraße“ wird die Sanierungsmaßnahme im vereinfachten Verfahren durchgeführt. Die be-sonderen sanierungsrechtlichen Vorschriften der §§ 152 – 156 BauGB finden keine Anwendung.

§ 3 Genehmigungspflichten Die Vorschriften des § 144 BauGB über genehmigungspflichtige Vorhaben und Rechts-vorgänge finden in allen Sanierungsteilgebieten Anwendung. § 4 Aufhebung bisheriger Sanierungssatzungen Mit In-Kraft-Treten dieser Satzung treten die Satzungen über die förmliche Festlegung der Sanierungsgebiete SG I b „Am Gänsberg“ SG III „Gustavstraße“ SG IV „Rednitzhof“ SG V „Helmplatz“ SG VI „Umfeld Jüdisches Museum“ SG VII „Kohlenmarkt“ SG VIII „Angerstraße“ SG IX „Theaterstraße“ SG „Jakobinenstraße – Fürther Freiheit“ SG „Gebhardtstraße“ außer Kraft. § 5 In-Kraft-Treten Diese Satzung tritt gemäß § 143 Abs. 2 BauGB mit dem Tag ihrer Bekanntmachung in Kraft.
